Federal court blocks Trump from imposing sweeping tariffs under emergency powers law

A federal court on Wednesday blocked President Donald Trump from imposing sweeping tariffs on imports under an emergency-powers law, swiftly throwing into doubt Trump’s signature set of economic policies that have rattled global financial markets, frustrated trade partners and raised broader fears about inflation intensifying and the economy slumping.

The ruling from a three-judge panel at the New York-based U.S. Court of International Trade came after several lawsuits arguing Trump’s “Liberation Day” tariffs exceeded his authority and left the country’s trade policy dependent on his whims.

But for now, Trump might not have the threat of import taxes to exact his will on the world economy as he had intended, since doing so would require congressional approval. What remains unclear is whether the White House will respond to the ruling by pausing all of its emergency power tariffs in the interim.

Trump might still be able to temporarily launch import taxes of 15% for 150 days on nations with which the U.S. runs a substantial trade deficit. The ruling notes that a president has this authority under Section 122 of the Trade Act of 1974.

The ruling amounted to a categorical rejection of the legal underpinnings of some of Trump’s signature and most controversial actions of his four-month-old second term. The administration swiftly filed notice of appeal — and the Supreme Court will almost certainly be called upon to lend a final answer — but it casts a sharp blow.

The case was heard by three judges: Timothy Reif, who was appointed by Trump, Jane Restani, named to the bench by President Ronald Reagan and Gary Katzman, an appointee of President Barack Obama.

A voice vote in August 2019 was in the middle of the Article III wars.

I’d be suspicious of the guy. Not all Trump judges were picked by Trump. Many of them were picked by Mitch McConnell and his minions.

Voice vote meant there was no argument from the Democrats.

More than a few. They may be a Ukrainian theorist, they may be a free trader, maybe they were for Romney, or DeSantis… And they love anything that they perceive gets even with Trump. Some of the same ones also very much enjoyed seeing the January Sixers locked up and resented them getting pardons.

And it’s more than just the 37 trillion, it’s actually far more than that. And it’s not just money, it’s the fact that all of our manufacturing was stripped mind and sent to the Third World, especially China. And if you listen to DC, we are on the verge of war with China, with Russia, with Iran, and God only knows who else. The tariffs are addressing that fact and have a goal of bringing manufacturing home. That’s not a national emergency I don’t know what it is.

NO. The court didn’t “issue a worldwide injunction against all tariffs.” To the contrary, many are still allowed. As the article says, “The ruling left in place any tariffs that Trump put in place using his Section 232 powers from the Trade Expansion Act of 1962. He put a 25% tax on most imported autos and parts, as well as on all foreign-made steel and aluminum. Those tariffs depend on a Commerce Department investigation that reveals national security risks from imported products.”

And now to address your second point about “a couple of people c[a]me whining.” It wasn’t a couple people. It was five businesses that were negatively impacted by the tariffs: V.O.S. Selections, FishUSA, Genova Pipe, MicroKits LLC, and Terry Precision Cycling. [Here’s an overview of VOS:

Any party, individual, corporation, church, or state authority has the right to challenge laws they think to be unconstitutional. As it happens, the plaintiffs got widespread support:

“The legal battle against Trump’s tariffs has created unusual bedfellows, uniting states led by Democratic governors with libertarian groups – including the Liberty Justice Center – that often seek to overturn government regulation of businesses. A dozen states have filed suit against Trump’s tariffs in the New York trade court.”

Well the advice that the Supreme Court has given District judges about ruling on the case before them rather than creating nationwide injunctions applies here as well. Rule for the 5 complainants and stop with the nationwide rulings.

Jane A. Restani took senior status in 2015 at 67 years old. She could have held on for a couple of years for a chance to pass the seat to a Republican.

Normal transition to senior status is 65 years old - she was 67 when she took senior status.

Do we still have to wait in suspense to see if the SCOTUS rules that federal judges’ ruling cannot be enforced on the entire country?

They same to be strutting arrogantly around in envy of Trump and out to cut him down because nobody likes them and he got to be the football quarterback and win the head cheerleader’s love.

That’s not how it works. The United States Customs and Border Protection collects tariff duties from importers. the new tariffs would affect about $2.3 trillion in goods. You cannot expect the U.S. Court of International Trade to dish out justice 5 or 10 plaintiffs at a time.

Reif has been a lifelong Democrat, volunteering for Ted Kennedy’s Presidential campaign in 1980, and volunteering for the Presidential campaigns of John Kerry and Barack Obama.

Reif also donated to the campaign of Hillary Clinton in 2016.
