Mike Davis: "If You Could Write A Playbook On How To Destroy The Judiciary, Roberts Is Running It"
RealClear Politics/War Room ^ | 11 May, 2025 | Mike Davis/Steve Bannon

"Article III Project" founder Mike Davis urges President Trump to suspend the writ of habeas corpus to repel the "invasion" of illegal aliens, Saturday on Steve Bannon's "War Room" podcast

STEVE BANNON: Just because we're hurtling toward a constitutional crisis on many fronts, what’s going to happen here? They went to San Francisco because, to a casual observer like myself, it looks like they're going to get the most radical appellate court—the Ninth Circuit—and get a stamp of approval there. Then this goes to the Supreme Court with backing. What’s your take on timing, seriousness, and when this will get to the Supreme Court?

MIKE DAVIS: Fortunately, in President Trump’s first term, there was an 11-seat advantage for Democrats on the 29-member Ninth Circuit. Trump reduced that to only a 3-seat advantage and appointed rock-solid constitutionalists like Lawrence VanDyke, Patrick Bumatay, and many others. So while the Ninth still leans Democrat, it’s not the judicial hellhole it once was eighty years ago.

Here’s how I see it playing out: the government will seek an emergency stay in the Ninth Circuit of this whack-job San Francisco Democrat judge’s ruling. If the Ninth doesn't issue a stay of the temporary restraining order, it should go to the Supreme Court on the emergency docket.

And to Chief Justice John Roberts, whom I personally like—I clerked for Justice Gorsuch—he's a good man personally and I like him, but if you could write a playbook on how to destroy the federal judiciary’s legitimacy with the American people and therefore with Congress, affecting its jurisdiction and funding, I think John Roberts is running that playbook -- unintentionally, of course. He thinks he's a master politician in a robe, but he's not.

I can't think of anything more destructive to the judiciary than these dozens of activist

Roberts is 100% compromised.
So is Amy Corny Barrette.
The 3 liberal justices are paid for each ruling - run down their personal accounts to see just how much.

Just maybe this “crisis” is what the misguided Judicial branch needs. After all, it is apparent to most US Citizens that these judges are overreaching at best...or are insurrectionists attempting to undermine our Republic.

No one is above the law.

I don’t think the three neurotic females need to be paid. They really are True Believers and immune to critical judgment. Idk about Barrett. Roberts clearly is not his own man. He may be “a nice guy personally” but so was Ted Bundy. Roberts is a snake and we all know it.

Are you who we think you are?

Are you a US citizen?

Is there any good reason why we should not toss you out?

Where are you from?

Where are you going to go?

Questions have to get asked.

These questions can be asked via a personalized paper form provided to the alien by the USCIS. They don’t have to be asked in front of people each getting paid $75 to $200/hour.

Any person that adopts a foreign child is likely to be a bleeding-heart liberal.

The Federalists were the ones that favored a more powerful central government.

Better questions needed to have been asked of judicial candidates.

Does Israel truly have a problem with judicial overreach?

Was having Parliament being the final judge in constitutional matters a better idea than the current UK system?

Was the PPACA levy a tax?

Would you hang a picture of Earl Warren in your office if you had to hang five pictures of past Supreme Court justices in your office?

Would you vote for Keir Starmer or Kemi Badenoch?

Does the UK have a free speech legal problem?

Who do you think should be President after me?

Do you think I was right in dismantling USAID?

Name the governor who did the best job handling Covid in 2020.

Name at least three other people I should seek to place on the Supreme Court should three more opportunities arise.

Ah, you think?? I’d say it’s a certainty!
1000% something no right with this guy!!
And it has to be big, cause he seems to have changed his judicial philosophy on a dime once confirmed.
A junior jurist, confirmed as Chief Justice, is as phony as a Pope, declining the position, cause he doesn’t feel well, and is replaced by a marxist!
Lots of funny business!!!!!

“Mike Davis urges President Trump to suspend the writ of habeas corpus to repel the “invasion” of illegal aliens”

Team Trump is simply not rounding up sufficient numbers of invaders to even justify considering suspending the writ of habeas corpus.

The legal tools Trump has are insufficient.

Trump should be able to deport undesirable aliens on any explicitly justified basis available to the alien’s government or of any visa-exempt country.

The Congress has the Article I, Section 8 power to make rules for the government.

Perhaps a new law:

Federal judges shall not make law, but merely help litigants get the benefit of the text and intended meanings of the provisions of the Constitution when they were placed into it, statutory law and the remnants of common law.

No ruling or decision by a federal district or appellate court judge on a case against a government, a governmental agency or governmental person shall be applicable beyond each private entity or private person individually listed within by name or personal particulars by the judge personally.

No federal judge who has or has possessed foreign citizenship may adjudicate an immigration, asylum or removal case.

No district court federal judge shall work on a case who has a parent, aunt, uncle, sibling, child, grandchild or known partner of such close relative or a personal partner with any case related interest.

The following district and appellate court judges are hereby barred from hearing cases where the federal government is a party or federal funding is in contention:

Every branch has oversight. When or how often is the Judiciary looked at by an oversight committee?
