President Trump has come out and said the "Maryland man" was a MS-13 terrorist gang-banger, an illegal alien from El Salvador, and was given an order to be deported, and that the Supreme Court ruled 9-0 that the courts cannot interfere with the Executive Branch foreign policy decisions.
Marco Rubio has said the same thing.
Stephen Miller has said the same thing.
The President of El Salvador has basically said the same thing and that this man is not going to come back to the United States.
The media keeps saying this terrorist gang-banger is a "Maryland man" (basically a citizen), the Supreme Court ordered he be returned, that the administration admitted his deportation was a mistake, and he is not a terrorist gang-banger.
My question - is this libel or not?
The Supreme Court did not order the man returned. The Supreme Court ordered the administration to facilitate his return. Facilitating is a different word.
2 judges determined that he IS MS13 and could be deported. At that time, his own attorney said that returning him to El Salvador would get him killed by rival gang. How do you get killed by a rival gang, if you aren’t part of a gang yourself?

Now, what I’ve read, Greta, suggests that what that means is, if he was worried about violence from a rival gang in El Salvador, that he’s effectively admitting he’s part of a gang himself,” Hakes said.
“And now that President Trump has designated MS-13 a foreign terrorist organization, he’s no longer entitled to that withholding of the deportation that a judge in some sympathy gave him in 2019 because he was no longer entitled to claim asylum,” she added.

Whenever I see or hear of some ‘Maryland Man’ who has been here working, contributing, etc. I think of the futures that he’s been stealing from my grandchildren.
I don’t care about their stories, what they dreamed of or worked for or whatever. I consider them thieves and I want them gone out of my country. There are too many other honest, hard working people out there in the world standing in line and waiting their turns.
WHY should we care that a murderer might have to face consequences from his enemies in his HOME country????

My 20-something daughter was listening to some older women lamenting that this guy was sent packing without due process. She thought to herself “What hypocrites. He came into the country without “due process” and they are just fine with that. But now they are complaining that he doesn’t have it when he leaves.”

To win a defamation case, a plaintiff who is a defamed public official or other public figure must now show not just that the claim sued on was damaging and wrong on the facts, but that there was a knowing or reckless disregard for the truth by the defendant. In practice, that makes for a difficult case for plaintiffs. Most just take their lumps and blast back at their accusers.

Then send the gang banger an airline ticket to facilitate his return. Springing him from jail is much more than a facilitation.
