A possible solution to Activist Judges
Original Content | 03/18/2025 | By Laz A. Mataz

Posted on 03/18/2025 12:39:08 PM PDT by Lazamataz

Recently, Activist Judges (I call them 𝐏𝐨𝐩-𝐔𝐩 𝐉𝐮𝐝𝐠𝐞𝐬©) have been hamstringing President Trump in nearly every effort he has taken to try to right the country. From interfering in ending Birthright Citizenship, to any Federal Funding Freezes, to Federal Employee Buyouts, to Access to Treasury Records...even trying to TURN PLANES OF DEPORTED GANG MEMBERS AROUND IN MIDAIR... there is nothing these people will not attempt to block.

Trump’s 2025 term shows an extraordinary rate—46+ judicial interventions in under two months, which dwarfs Biden’s 5 TROs in four years, Obama’s 20 in eight, and Trump’s own first-term 40 in four. There is a 45x higher rate than Biden’s for February alone.

Trump’s current term stands out for its immediate and intense judicial resistance, outpacing all predecessors in speed and scale, driven by controversial immigration and governance reforms. Earlier administrations, even recent ones, faced fewer and slower challenges, highlighting a unique moment in executive-judicial dynamics.

Solutions have been offered such as ignoring the orders or impeaching the judges, neither of which strikes me as a true solution.

But there is an action that DOES strike me as a solution: Jurisdiction stripping.

In United States law, jurisdiction-stripping (also called court-stripping or curtailment-of-jurisdiction) is the limiting or reducing of a court's jurisdiction by Congress through its constitutional authority to determine the jurisdiction of federal courts and to exclude or remove federal cases from state courts.

I'm unclear if this would require only the House or the House and Senate. If it is the latter, then this would not work either.

Discuss.

Great plan. Except Congress will do nothing of the sort. Aside from that it should work perfectly.

This problem, like most, is best done by Congress.

Now, how to stir them from their slumber....

Subject to Senate filibuster.
In other words, not a possible solution at all and a waste of discussion.
Unfortunately.

It would take a law, meaning both houses of Congress. But here is some different leverage: the judiciary is not self-funding. Take Roberts’ play money out of the judicial branch’s budget, which must be approved by Congress every year. Make them sweat.

Sorry, Mr. Mataz...

But with this, the Tesla burnings, Swattings, etc. ‘playing fair’ is starting to get real old, and I can imagine some folks are getting a short fuse right about now.

...and it ain’t even summer yet.

With all due respect, there are folks on OUR side who believe the most important mission of government today is the release of the Epstein logs, and documents about dead politicians from over 50 years ago. Others are demanding Ms. Bondi and Mr. Patel do something - anything to deal with this.

But I have yet to hear anyone propose what WE THE PEOPLE can and should be doing - before the enemy goes beyond Tesla and courts with their uprisings.

Think about that for a minute, but don’t let you mind wander too far; it can lead to dangerous places.

I updated an article earlier today on dealing with swattings. I say this to EVERYONE: Before this Tesla thing leads to uglier, deadlier actions, perhaps its time for folks to get together locally and offer to security patrols these dealerships. Perhaps lay ‘bait’ out for a few would-be perps.

Yes, a show of force on our side would counteract these actions, and no - I’m not talking about going kinetic (at first). But to also consider taking pre-emptive actions to learn where these lurkers are located BEFORE they act (I’ll bet there is a profile that could help us narrow it down).

As far as the ‘gavel presidents’, I would love nothing more than Administration officials - even the President himself - start having press gaggles RIGHT IN FRONT OF A JUDGE’S RESIDENCE. What better way to send a message that we are serious. As far as the swatters: If you find yourself surviving these events, make it a point to get all the information about the source of the call; even if you have to sue to get it. Then make those SOB’s public.

Yes, Mr. Mataz. We on the Real American socials make it our policy of non-violence. It is strictly enforced. But we have to appreciate the facts that our adversary is NOT playing by the rules. Having nothing else to offer, they have been reduced to their base nature.

As Real Americans, I propose we begin to act according. Let’s starting acting like Mr. Andy Ngo now, so we don’t have to act like Mr. Rittenhouse later.

Just my $0.02.

P.S. See Mr. McGee for more background information.

https://www.perplexity.ai/search/what-is-jurisdictional-strippi-bK5BOZrOSFWNJXmHM1dtxQ

From the link....

However, there are limitations to Congress’s jurisdiction-stripping power. The Supreme Court has held that Congress cannot:

Impede the judiciary’s power to decide cases independently

Dictate how a court should rule in a specific case

Instruct courts on how to apply existing law to facts in a given case

______________________________________________

The Supreme Court? Roberts’ Court?

As my favorite FReeper (of whom I want to switch sides and hit that) is fond of saying......

We are so screwed.

I tried to find an earlier article that gave an example of the Chief Justice removing jurisdiction from an inferior judge after he repeatedly ignored the SCOTUS rulings. It was during the GW Bush administration and Bill Barr was AG. However, given this spineless and in my opinion, corrupt Chief Justice Roberts, it would be easier to get Congress to act to strip jurisdiction from these rogue judges. But, they would ignore it as they are doing now. District Judges do not have jurisdiction over any immigration actions. The appeals courts are the first judiciary that has any jurisdiction is my understanding.
I wrote earlier that Because these judges are ruling on issues over which they have zero jurisdiction, I think Trump should do an executive order ordering these judges that have ruled against him on topics over which they have no jurisdiction to reduce their staff by at least one half to reduce the deficit, and not hire another person in their place. It is obviously not under Trump’s authority to tell the Judiciary who they can hire or that they must reduce costs or fire people, but it would highlight just exactly the overreach these corrupt judges are doing. It would also make heads explode but maybe it would get that corrupt weak John Roberts off his ass and bring these judges under control because in addition to ruling on things over which they have no jurisdiction, they are also ignoring SCOTUS precedents.

Just force the Dems to debate 24/7. Eventually they will cave.

I think this is the key. I think Trump should just ignore them on this argument and the push it to the SCOTUS.

It takes 60 votes for cloture in order to get to a simple majority vote in the senate. The Dems were of course all in favor of ending the filibuster when they had a majority but it is anathema now that they are in the minority. Telling the judgeto go piss up a rope would of course leave him powerless but it would be grounds for impeachment and there are a bunch of weak kneed Republican senators that might vote to impeach.

No the solution is to file emergency appeals to the SCOTUS and work them to death until they and Roberts get tired of the BS and slap these district court judges down brutally.

Trump should just show each of these judges the file he has on them.

They wouldn’t care. Boasberg is a corrupt judge appointed by Biden (or was it Bammie?) and his daughter is also openly biased.

DOGE is going to find corruption and USAID seems to be the hub of it all.
The hate for Musk is because DOGE is cutting off their illegal dealings.
Auditing by the IRS would be the quickest way to put fear into all of them.
Audit those that make the most noise.
Nobody wants to hear that the IRS wants to audit them.

Tucker Carlson interviewed Doug Macgregor. At the 39:00 mark, Macgregor says that the Mexican cartels own our politicians.

CONFLICT OF INTEREST: Family of Corrupt Obama Judge Ordering Deportation Planes Back Deeply Compromised
By Pamela Geller - on March 18, 2025

CONFLICT OF INTEREST EXPOSED

Katherine Boasberg, who works for a 501(c)(3) organization called Partners for Justice PFJ_USA as a “capacity building associate”. In her position, she helps coordinate and administer grant activities, ensuring compliance, and supporting the delivery of capacity-building programs to strengthen nonprofit infrastructure.

The Judge’s daughter focuses on criminal defense and advocacy as an employee of Partners For Justice.

Partners for Justice is an organization that derives 76% of its funding from GOVERNMENT GRANTS!

One daughter Melissa Boasberg worked the John Kerry campaign along with Susan Rice.

The wife of the Obama judge blocking Trump’s deportation of illegal criminal aliens is the founder of an abortion NGO funded, indirectly, by USAID and Soros.

It seems that Judge Boasberg has a clear conflict of interest & is obligated to recuse himself from this case, as outlined in the Code of Conduct for United States Judges, which specifies the circumstances under which a judge must disqualify themselves from a proceeding.

The disqualification clause states the following:

“A judge shall disqualify himself or herself in a proceeding in which the judge’s impartiality might reasonably be questioned, including but not limited to instances in which:

The judge or the judge’s spouse, or a person related to either within the third degree of relationship, or the spouse of such a person is:

Known by the judge to have an interest that could be substantially affected by the outcome of the proceeding.”

It might be able to pass the Senate if courts were included in the “no filibuster” category, as judicial nominees are under the Reid Rule.
