As the money flows, the Supreme Court’s failure to act enables unchecked judicial activism.
The Supreme Court’s recent refusal to vacate the lower court’s order in the USAID case has sharply divided legal observers—especially conservatives. Some initially dismissed it as a mere procedural hiccup, a fleeting technical matter that would quietly resolve itself.
They were wrong then. They are even more wrong now. Judge Amir Ali’s latest ruling makes that painfully clear.
As someone who has served as a judicial officer on appellate review, I know how these battles unfold behind closed doors. I’ve seen colleagues wobbly in their convictions. I’ve written blistering dissents. I’ve withheld dissents when persuading a majority to reconsider. That is precisely why Justice Alito’s fiery dissent—joined by Justices Thomas, Gorsuch, and Kavanaugh—must not be rationalized away.
Some legal analysts still insist this case is minor. Why did Alito and the conservative wing sound the alarm with such force if that were true?
They weren’t quibbling over technicalities. This wasn’t just a procedural disagreement.
It was a judicial broadside—a full-throated rebuke of Judge Ali’s overreach and the Supreme Court majority’s failure to stop it.
Yet the dissent's harshest terms weren’t aimed at Judge Ali. They were squarely directed at the Supreme Court majority—particularly Chief Justice Roberts and Justice Barrett—who had the power to stop this and failed.

Judicial overreach never seems to come from the right to stop the marxists.
“Judicial overreach” is the torpedo aimed directly at the heart of United States jurisprudence.
Mission accomplished.
The answer is simple.
Take a playbook page from the puppeteers of dementia Joe and don’t make the payments.
blackmail working its magic? you decide.
Aren’t the Judicial, Executive and Legislative branches meant to be separate?
This isn't about differing interpretations of jurisprudence. This is about doing your job or not doing it. While DC may have been willing to overlook Biden not showing up to work for 4 years, I will not tolerate key officials at any level not showing up for work.
Malta and his wife, who runs the satellite controls decide,
and NOT the elected President. Until THEY are charged.
I’ve said for years that the American judiciary is no friend to us. Going back to the 70s sKotus and legal abortion and legal porn. They were demonic then and haven’t changed.
This Canadian muzzie needs his commie butt deported. He’s not an American. Where does this boy get the authority to decide who gets to raid the U.S. Treasury. Deport him or lock him up for theft.
SCOTUS - DO YOUR JOB!
Well, at least now we know why Barrett decided to allow a muzzie foreigner to raid the U.S. Treasury. Somebody, most likely DemonRATs, have made death threats against her sister.
Why not just ignore this ‘judge’ like Biden repeatedly ignored SCOTUS.
Look into this judge’s correspondence, emails, texts, phone records and bank accounts. I bet there is GOLD.
I believe our Constitution says if a law (ruling?) is not in accordance with Constitution, then it is the duty of the leader to NOT obey it. If the leader obeys the unlawful thing then subordinates on down have the duty to step in and stop it.
Congress needs to get it together and come up with a way to get rid of the foreign refugee bastards in the judiciary put in by Joe Pedo and the Kenyan.
Don’t make the payments. What will Ali Baba do? Enforce fines? Don’t pay those either. Then what will he do? Curse at Trump in Arabic? Will the House impeach Trump? NOTHING will happen, except perhaps the overdue rebalancing of Executive power.
Roberts is loving this. He sees himself as the final word. It’s strictly a power thing with him.
Congress or whomever should at least take up impeachment of them, if if not removed. Let their record show times they do not abide by their oaths to follow the Constitution, not their own personal whims.
bkmk
Not making the payments is terrible optics for Trump. It’s red meat for the talking heads and grist for the Low iq lib. Another shouting point on Sunday talk shows.
