Please explain to those of us in flyover country, what congestion parking tax is and why Trump and/or the federal government has anything to do with it.
They were a driving fee, not a parking fee. Drivers had to pay them regardless of whether they parked or not.
It is a tax proposed across state lines, so it is a federal issue. The poor people in New Jersey who work in New York have no representation there. Biden changed the law just before he left office. So Hochul is suing because she doesn’t want the Feds involved.
I am corrected.... Delivery trucks impacted most. I am sure they pay lots more than automobiles. X has a few videos on how to dodge these fees. One was driving your car through an underground garage.
I have read that the money involved (500m) is almost exactly the yearly loss to the MTA subway authority from turnstyle jumpers. So, in effect, the “congestion tax” was a subsidy for criminals. By criminals.
Simply put its not a parking tax, it is a fee being charged to simply drive your car in certain parts of the city.
If NYC was simply raising its parking rates, the fed wouldn’t be involved.
I am pretty sure it is against FEDERAL LAW to charge a toll when you don’t have any alternate route, which is why NYC needed the federal exemption that Biden gave them to enact this in the first place.
THe toll applies to every single street south of 60th I believe. So the entire southern part of the Island of Manhattan is effectively blocked from any sort of way to vehicle traffic without paying the tolls. Which is against federal law.
The Fed’s have no right,nor business in this matter. It is a state’s rights issue and the tenth amendment says they have no say. The hypocrisy of some people here is mind-blowing. They get all worked up when the feds step on their chosen to like rights in a state but want the same fed to step in when they don’t like something and want daddy fed to “do something”. They whine about the commerce clause and in the next breath when the feds uses the same commerce clause to limit say gun rights they scream bloody murder and thats a States right issue. You can’t have it both ways.
This is a clear NYS sovereignty issue they will win if it goes to federal and the Supreme Court. The tenth amendment is clear it’s written in English that a grade schooler can understand. The elected representatives passed a law and got it signed by the governor it’s not something the Fed’s can or should be involved with. Please show me in the enumerated powers of the constitution where the damn feds can not should tell a sovereign state how to manage it’s roads I’ll wait.

Trump is issuing this populist Executive Order to boost NY ratings for all NY Republicans. He will/might lose in court, but this is not a factor.

No it is not, if people CHOOSE to cross sovereign state lines that is on them. As for the commerce clause are you a conservative really going to use the much abused commerce cause because remember that when the same fed tramples all over your state rights and law making ability say for gun rights. How about Texas silencer law where the feds used the commerce cause to void the law where if a suppressor was made in Texas, by Texans for Texans only then it was legal and not an NFA item. Yeah that commerce clause.
Do you live in NYC? Have you ever lived there if not then you have exactly zero say in how the sovereign state of New York runs their cities or roads. This is a clear tenth amendment case and NYS should win it unless the Supremes use the damn commerce clause again to bash states rights. No conservative EVER should support using that damn clause for anything othere than actual goods moved across lines and it was to keep the states from tariffs on each other not to empower the fed to override every aspect of the economy and laws just because a person or good crosses state lines. The hypocrisy is my numbing.

You can’t have it both ways. The Commerce Clause is used to justify the expenditure of federal dollars on roads, bridges, and public transit systems in New York. That being the case, what is the basis for any objection about that same Commerce Clause being used to scrutinize and regulate HOW those federal dollars are spent?
I’m sure Trump still has a soft spot in his heart for NYC.

First trump is not king , he will lose and should lose and real small government conservatives should cheer that loss as it’s win for state’s rights and sovereignty. The federal executive branch has no enumerated powers over a state’s legislative process. If the law is unconstitutional at the federal level take that up with the federal district then Supreme Court. NYS Supreme Court has not said this law is unconstitutional at their states level. The Fed’s for sure will argue commerce clause and if they win it’s another loss for ALL 49 other state’s rights that should be appalling to real conservatives. We get it you don’t like the law ,if you do not live in NYS then tuff titties it’s none of your business the citizens of NYS voted, their representatives passed a law and their governor signed it. That is exactly how the Republic should work.
I just repeated what the newscast said was the reason for the lawsuit. I can see you are very passionate about the issue and you should post some articles educating us not in NYC or NYS.
Why is the state passing a law that only applies to NYC?
The State of NY has been passing laws that control NYC for hundreds of years. It is just the way they do things.
Also of note, congestion pricing IS price gouging, and NY has laws prohibiting price gouging.
Exactly the commerce clause is abused. And the Fing Fed’s have no business in the road funding game. That is no where in the constitution ,we are 30 trillion in debt because the feds fund and spend on things then never should.
In the North East interstates built with and maintained with Federal money are tolled New Jersey tolls every interstate in its borders, those were built with Federal money and the tolls go to the state of New Jersey. The Fed’s oonly recourse is withhold money once it’s given tuff titties , they never should be in that business anyways it’s not one of the 8 enumerated powers they hold.
Sorry your commerce clause aarguments are flawed from the start the whole use of the clause is against the purpose of the constitution and the limits purposely written in TWICE with the tenth amendment added to make sure the feds knew their limits. Then post Lincoln and his war of aggression against sovereign states illegally over stepped by the federal government.
Again no true conservative should ever lean on the commerce clause it’s after the income tax the worst thing ever put to the American Republic. Period full stop.

I lived in Hells Kitchen while at University for four years so I am fully aware of how The City works, I have also subsequently lived outside London. Congestion charges work and work well. I was just in NYC and it’s night and day. No more 30+ min wait for an UBER to creep to you. What used to take 2 to 3 hours in rush hour in London can be done in 1 now from the greenbelt to the center of London.
It’s irrelevant this is a state’s rights issue. Giving the fed even more of our states rights just because boomers in flyover country don’t like something NY citizens voted for is the peak of stupidity.
