7th prosecutor on Adams case resigns, slams Trump DOJ’s ‘dismissal-with-leverage’ gambit on way out: ‘Never going to be me’

A seventh prosecutor resigned Friday rather than heed the Justice Department’s order to toss Mayor Eric Adams’ criminal case — and suggested only a “fool” or “coward” would comply on his way out.

Hagan Scotten — an assistant US attorney in the Southern District of New York and the lead prosecutor on the case — said in a scathing resignation letter that dismissing the bribery, corruption and other charges against Adams was a “serious mistake” that keeps Hizzoner beholden to President Trump.

“Any assistant US attorney would know that our laws and traditions do not allow using the prosecutorial power to influence other citizens, much less elected officials, in this way,” Scotten fumed.

“If no lawyer within earshot of the President is willing to give him that advice, then I expect you will eventually find someone who is enough of a fool, or enough of a coward, to file your motion,” he added.

“But it was never going to be me.”

Scotten blasted the Trump DOJ’s “dismissal-with-leverage” proposal — admittedly made without considering how strong the evidence is that Adams took Turkish bribes — as an unlawful ploy to force the mayor to comply with Trump’s immigration agenda.

“No system of ordered liberty can allow the Government to use the carrot of dismissing charges, or the stick of threatening to bring them again, to induce an elected official to support its policy objectives,” he wrote in the one-page missive.

The prosecutor and veteran, who served three combat tours in Iraq as a US Army Special Forces officer, added that he could understand how Trump, “whose background is in business and politics, might see the contemplated dismissal-with-leverage as a good, if distasteful, deal” — but that the DOJ lawyers should know better.

Many prosecutors tend to develop "target lock" against their adversaries and become determined to get a kill even if there are weaknesses in a case that compel dismissal.

Will a jury with black members convict a black mayor in New York? That is highly doubtful.

Due to five black jurors, in 1990, DC Mayor Marion Barry famously beat the rap in a drug case spite of compelling proof on video. Similarly, in Tallahassee, in a case that AG Pam Bondi would have seen in the media, the loyalty of a black jury meant that the federal government could not get a conviction of a black former mayor for corruption.

There is simply no good reason for the Trump Department of Justice to want to be accused of racism while almost certainly losing a criminal case against the black mayor of New York for illegal gifts that resulted in minimal if any harm to the public.

I read Emil Bove’s long letter to Sassoon accepting her resignation & going through why the charges were being dismissed - seemed well-reasoned to me. As the saying goes, she ‘got the stick with the bark on it’. He blistered her IMO.

Personally, I think these prosecutors are bailing out because they see the handwriting on the wall with a ‘new’ DOJ, one that doesn’t engage in lawfare. The Adams case gives them an excuse to bail out while blaming Trump DOJ & sounding like they have the higher ethics & morals.

Speaking of someone who should know better, I have to wonder how many deals this guy has cut with people he KNEW to be guilty, but allowed him to attain a bigger objective.

IIRC, no one resigned when leftwing lawfare was scheming to take out Trump. They sat on their hands and said and did nothing.

Those who are resigning over the Adams case will get no respect from me.

The left wing law firms may not be hiring right now.

Many of them were dependent (directly or indirectly) on the federal government money machine keeping their clients in the black.

Even if that was only 10% of their business it would be enough to stop new hiring dead in its tracks.
