Some questions for the group. These questions came to me as I continually hear how the progressive/statist areas of the United States will not allow ICE to enter the public schools to pick up illegals.
Is the Department of Education the ultimate controlling authority of the public schools?
If they are the ultimate controlling authority, does that not make every public school in the nation a Federal building?
If they are Federal government buildings, can't ICE - being Federal - enter the Federal building?
Looking forward to hearing your answers.
The DOE is a bank. That bank issues money to education institutions provided they meet regulatory mandates of social issues, or whatever the regulatory agency says they want as a condition of being “funded”.
I am open to discussion on many of the agencies, but:
HUD should be in the southside of Chicago, in a building with no parking so that employees would have to take public transit and walk.
EPA should be in Houston, in a building with no air conditioning.
ICE has said a lot of illegal, violent MS-13 gang members are high school - and even middle-school aged and that is why the edict came down about ICE being able to go into the schools to pick up these criminals.
This is what the public schools wish to protect.
States and localities control the schools and the buildings and who enters them but that just means ICE needs a warrant to go in which is not that hard to get. Localities might make a good show of resistance but resistance is futile and could cost them in a vast multitude of ways not the least of which is funding for virtually everything from roads, brisges, schools, police and fire services, homeless programs etc etc. Federal government doesnot have to deny anything, simply dragging their feet will do the trick. As LBJ allegedly told one Senator “That’s a nice little military base you got there. It’d be a shame if anything happened to it.” It is no coincidence that NASA facilities are spread across Gulf (of America) Coast states Texas to Florida. That is ten Senate districts. LBJ knew how to get things done.

The states have never expressly constitutionally given the feds the specific power to dictate policy, regulate, tax and spend in the name of INRAstate schooling.
In fact, President Thomas Jefferson had clarified, in a State of the Union address, that the states would first need to appropriately amend the Constitution before Congress could stick its big nose (my words) into intrastate schooling, something that the states have never done.
"The great mass of the articles on which impost is paid is foreign luxuries, purchased by those only who are rich enough to afford themselves the use of them. Their patriotism would certainly prefer its continuance and application to the great purposes of the public education [all emphases added], roads, rivers, canals, and such other objects of public improvement as it may be thought proper to add to the constitutional enumeration of federal powers.” —Thomas Jefferson: 6th Annual Message, 1806." (Jefferson is indicating that Congress cannot tax and spend in the name of intrastate infrastructure imo.)
"From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]." —United States v. Butler, 1936.
That being said, the post-16th Amendment ratification (direct taxes) feds have also been ignoring that the Supreme Court had clarified that Congress cannot appropriate taxes in the name of state power issues, public school policy uniquely (military training aside) a state power issue.
"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." —Justice John Marshall, Gibbons v. Ogden, 1824.
And since elite desperate Democrats and RINOs have also weaponized public schools against the family unit imo, if I understand correctly, it's good that PDJT47 is going to get rid of Education Department.
Local school boards and state dept of education are in charge
