The issue is not the First Amendment.
The issue is whether the pollster and/or the newspaper were paid to lie, then knowingly and maliciously lied, and then failed to disclose it in a timely manner.
If that lie harmed anyone those harmed may have a cause of civil action.
Based on the available data, she had a bad poll.
And not the first time.
Who was the harmed party?
It was not a “bad poll”.
It was deliberate fraud.
