The wife of a Wisconsin kayaker who faked his own drowning so he could leave her and their children and meet a woman in Eastern Europe filed court documents Thursday seeking to end their marriage.

Online court records indicate Emily Borgwardt filed a petition in Dodge County Circuit Court seeking a legal separation from Ryan Borgwardt. According to the petition, the marriage is “irretrievably broken." The document doesn't elaborate.

A woman who answered the phone at the office of Emily Borgwardt’s attorney, Andrew Griggs, on Thursday said he would have no comment. Online court records don’t list an attorney for Ryan Borgwardt.

The separation petition states that the couple has been married for 22 years and Emily Borgwardt wants sole custody of their three teenaged children. The document adds that Emily works at a private school in Watertown. Ryan is listed as self-employed and currently residing at an “unknown address.”

A hearing in the case has been set for April.

Ryan Borgwardt, 45, was reported missing on Aug. 12 after telling his wife the night before that he was kayaking on Green Lake, about 100 miles (160 kilometers) northwest of Milwaukee. His disappearance was first investigated as a possible drowning. But subsequent clues — including that he obtained a new passport three months before he disappeared — led investigators to speculate that he faked his death to meet up with a woman he had been communicating with in Uzbekistan, a former Soviet republic in Central Asia.

Is this the guy who had stashed a bike in the woods near the lake shore, and had taken an inflatable raft with him on the lake? There was a crime documentary on Youtube a while back.

I'm often appalled by the way one parent gets raked over in divorce by the other, whether male or female. But in this case, I'll make an exception. Throw the book at him. Award her any discoverable assets such as a house or cars. Capture any money from wherever he has stashed it, and lock him under the jail until he agrees to be a willing wage slave to pay for his wife's alimony pendente lite and his children's therapy and educations.

Regarding the jerk that faked his own death, I’d say a divorce would have been appropriate. Then he could do whatever he wanted with his Russian girl in the open.

Clearly his motive was to avoid having to pay for supporting his children.

Maybe, maybe not.

Was his life in perilous, imminent danger by remaining with his wife and children? If yes, was faking his death his only option to save his life?

If not, there is a cultural presumption that cheating in marriage is wrong. Yes, a lot of people do cheat but not to this extent - faking one’s death and leaving the country. Since you say you have worked in a lot of marriages, maybe this is very common to you then? I never knew anyone who took this type of approach or made such an effort to cheat on his/her spouse.

“Investigators contacted Borgwardt through information they found on a laptop he left behind, including a photo of the woman he traveled to meet. He told investigators he had to leave the laptop behind to make his death believable but left too much information on it, according to the complaint.

Podoll said in November that investigators found passport photos, inquiries about moving funds to foreign banks and communication with a woman from Uzbekistan. They also discovered that Borgwardt took out a $375,000 life insurance policy in January. Podoll has said the policy was for his family.”

I do not think it has to do so.

Poor kids.

Mom and Dad may both deserve what is coming but the kids are innocent parties and that is a lot of muck to have splashed on you.
