I agree with him. Want pot legalized, then do it at the State level. Then it becomes legal in the entire state. It, like abortion, should become a State issue. That is another area that does not need to be at the Federal Level. Because neither issue is mentioned in the Constitution, and therefore rightfully becomes a State issue that is up to the state to vote on by the entire state, not a city here & a city there.

The Texas state constitution prevents cities and municipalities from passing laws that are inconsistent with state law:

Article 11, Section 5
"no charter or any ordinance passed under said charter shall contain any provision inconsistent with the Constitution of the State, or of the general laws enacted by the Legislature of this State."

Paxton should have a slam dunk case, but there are so many bad judges out there, who knows?
