Judge in Trump’s ‘hush money’ trial considers tossing felony conviction after election win

The Manhattan judge who oversaw Donald Trump’s hush-money criminal trial is expected to announce next week if the now-president-elect’s historic felony conviction will still stand.

Manhattan Supreme Court Justice Juan Merchan had already delayed sentencing by more than four months to come after the election — and gave himself until next Tuesday to decide if the conviction should be tossed.

Trump’s overwhelming election win will now further embolden his legal team “to make sure that sentencing never happens,” CNN chief legal affairs correspondent Paula Reid noted late Wednesday.

“Here, they’re going to argue to the judge that the sentencing should never happen because now that Trump is president-elect,” Reid noted.

“They will say that he is entitled to the same constitutional protections as a sitting president and should be protected from state actors, and in this case, state prosecutors.”

Personally I think the Judge has been looking for a way out of this crap show since the end of the trial. Now he has it.

I expect him to find a way to leave one charge and fine Trump so he can still say “convicted felon.”

IIRC judges in this country have the power to declare a defendant “not guilty” even if the jury ruled him/her to be guilty. Let’s see if this judge moves to save his a$$ by doing just that.

EVERYONE involved in this BS fiasco needs to be arrested and tried for election interference, along with Merrick and Smith. All should be sentenced to life in prison at GITMO as domestic enemy combatants. Give em a taste of lawfare grape shot....see how they like it.

Merchan tryin’ to peddle backwards? Look at all his rulings where he threw out exculpatory evidence, fabricated predicate crimes, screamed at Trump like he was already guilty, the abuse was never ending.

Screw him. Impeachment, debarment and trial for abuse of power.

The wetback cur knows his days are numbered — occupationally for sure, possibly physically - if he continues to f-— around with President Trump. I’m hoping for that well-deserved tactical raid on his daughter. She’s up to her eyeballs in dirty money and she and Daddy both know it.

There need to be a thorough investigation into whether there was any wrong doing in these Trump prosecutions.

If the investigations uncover any collusion, misdeeds or abuse of power while in official office those responsible need to prosecuted to the full extent of the law.

In government prosecutions, the punishment is the process.

They tried to break and bankrupt Trump with years malicious lawfare prosecutions that cost Trump over a hundred million in legal defense fees alone.

Now it's time for them lawyer up with $100 per hour lawyers and empty their bank accounts

Merchan already knows his rear end is flapping in the wind and the hammer will be about to fall. Any dropping of the case will be for survival. In some ways I’d like to see the appeal process go forward, just to crush this arrogant ignoramus with delusions of adequacy.

My prediction is that Merchan will sentence Trump to 1 year in prison and then suspend the sentence for four years, to be served after Trump's term in office expires.

Trump's appeal will still be heard, and Merchan will rely on the appeals court to overturn the conviction on the grounds of misapplication of the law (bootstrapping dead misdemeanors into felonies) before Trump leaves office, and before Trump would have to serve the sentence.

I also think that the appeals court will overturn Engoron's unconstitutional fine on the grounds of misapplication of the law (using consumer protection laws) when no parties were harmed and business was conducted in a manner that was normal to the industry. They might also find that the fine was excessive and that by not having a jury trial the finding that the valuation of Mar-a-Lago was overstated was arbitrary and capricious and went against expert opinion of the value of real estate on the Florida coastline.

From what I have seen of Trump I think he will give mercy to those that attacked him directly. I wouldn’t be surprised, however, if he went after the J6 tormentors with some zeal.
