Things not to say so the general public, the layers and the insurance companies don’t hear ya.
So this happened over a year ago and no charges have been filed.
Maybe the DA has decided it was just an unfortunate accident.

Sounds like the five probably died quickly. I remember a dash-cam video from 2000 that showed an LEO driver getting out of his car and walking into a cloud of anhydrous ammonia to check on victims at a vehicle accident scene. He obviously didn’t identify what was leaking into the air from the small trailer. His radio mic was on and he just walked into the cloud, coughed, and keeled over. He didn’t breathe much longer.
That is really a dangerous chemical. A small hose leak can kill a farmer instantly. A small amount can create a large kill zone. It basically takes your breath away before you know anything.
You shouldn’t expect the person you are passing to have to put on their brakes. Mom should have taken the car away at first sign of dangerous passing.
I think too many careless, stupid incidents on the road are misrepresented as “accidents.”
These insane lane-jumpers passing traffic madly at 85 mph should be held criminally accountable WHEN they cause “accidents.”

For the first couple of years I had a drivers license I was a dangerous menace and greatly put at risk every vehicle on every road I traveled.
Yeah, this girl is an idiot but there but for the grace of God ..

The truck driver would considered at fault by law, since there was no contact the reckless four-wheeler.
Truck driver lost control of his rid causing deaths.
There is a rule to keep truck drivers from liability of a crash: “You cannot avoid a wreck and cause a wreck.”
Driver should have maintained his lane and straight line braked only enough to decrease his speed to minimize his damage from contact if such were to occur.
The HazMat driver has his own legal obligation not to endanger the public with his cargo by his actions.
What struck me is that she really accepted responsibility. OK, legally unwise, but this seems so rare nowadays when people “misspeak,” “cause discomfort to another,” etc.
And she just said, wow, I didn’t realize I did that, but I did that.
We don’t have enough information to make a determination IMO. It sounds like there is shared responsibility.
She needs to have files charged for the deaths of those five people.
Seems like there are several people here who have made no errors while driving.
