"Disparate impact" rests on the foundation that

(A) BECAUSE there are no significant differences in ability between genetically distinct groups, THEN

(B) ANY differences in measured ability (IQ, etc) or performance outcomes MUST be due to racism in the measuring test.

If B is invalidated, then they must admit that A is false, and they will NEVER do that.

One answer not motioned on the article: LOCALIZE THE POPULATION % BY RACE.

The Lying Left says blacks are 13% of the population. But what is the % black population in, say, NYC or LA? Match the % black population in each city to the black crime in each city, and you’ll get closer to how the police and DA should be approaching their problems.

It's impossible to take seriously an organization that espouses that. They've lost all credibility.

While I was in the hospital a young black woman came into my room and said, “I be Dr. xxxx and I be doin’ your operation tomorrow.” As I hadn’t heard the test results that were needed and the operation was based on, I questioned her. She hadn’t talked to anyone else on the diagnosis team. She hadn’t read my reports. When I asked her technical questions about why I needed the operation she repeatedly used the phrase, “I tell you what the text say, the text say (xxx).” When I spoke to the original surgeon and related what had happened, she rolled her eyes and said, “I’ll take care of it.” The original surgeon did the operation, and I was very happy. I never saw the other woman again.

In the next hospital stay, I bled out due to a medication mistake. I collapsed to the floor at about 3am. When I came to a black surgeon and two orderlies where running while pushing my gurney. The black guy was on the phone fighting for a space and being repeatedly denied. Fast as hell on his feet, he called someone else and asked if the maternity operating room was open. It was. They changed direction and he was yelling into the phone for someone to get the required equipment and blood to the maternity section. I had every confidence that if I could be saved, he’d do it. His grammar and English were picture perfect. Huge difference.

The doctor that did my heart surgery was from India. The anesthesiologist was a white woman. I selected him because he was the best in that teaching hospital and head of cardiac surgery and a professor.

My dentist is Vietnamese. My regular doctor is a woman. When I had electro cardioversion my doc was a lovely lady from Mexico. My orthopedic surgeon was a white boy. The instructor that taught me to fly multi engine aircraft was a white lady. Southwest Airlines valued her skill and she became a senior training captain. All were selected by my estimation of their expertise.

I tire greatly of this insane political correctness. I look for skill and expertise, I do not look at color or sex.

I would say it is characterized by tyranny practiced by our government. Mandating certain experimental drugs and labeling them as "safe and effective" without inadequate testing for one.
Certain medicines are prescription when I should be able to buy them without nanny government requiring me to go to a doctor for a prescription (especially maintenance drugs that a person is required to take to maintain life/qualityoflife).

One of the tragedies of the DEI movement is that they will make it impossible for qualified black physicians and other professionals to work and achieve the same success as whites. In the past I could go to a black doctor and have some assurance they are competent. Now - and the same logic holds true whether the patient is white or black themselves - a patient has to consider the risk that a black doctor is a DEI (Didn’t Earn It) grad. How can we entrust our health or other important activities to a DEI quota recipient? It’s too much of a risk, and the public will respond accordingly.

The problem is the federal courts, especially the US Supreme Court, in permitting the disparate impact theory to take hold in American law. In essence, once a racial disparity is shown, the burden shifts to show that it is not the result of racially discriminatory policies.

In practice, proving the absence of discrimination to a mixed race jury involves a costly and disruptive effort to prove that the defending organization and every person and decision-maker in it are not racist. The easier if ultimately toxic way to avoid that is to admit and promote unqualified people and fervently preach DEI and its mindless slogans and teachings.

I was in HR in late 70s when “disparate impact” started...I hated it, refused to learn how to calculate...eventually left HR...felt like a gov’t job.

If the AMA started recommending Chinese herbs or home remedies from the South, it wouldn’t be that scientific, but it might be better than the crap being shoved at us by “whites” who work for Pfizer and Moderna.

Examine each individual by the content of their character and the rationality of their thoughts. Listen to every word coming out of their mouth. Their reason, their expertise, their honesty, their respect for other thinking and other life is very important.

unequal results can be the result of many factors beside racism. For example take two identical twin greyhounds. One is well fed, trained to race and practices regularly. The other lays around all day, eats what it can find, is untrained and poorly disciplined. Which one do you think will win a race 99.9% of the time?

There is a single false assumption behind these insanities, and that assumption is that “all races are, on AVERAGE are the same.”

If you start with that assumption than the “disparate impact theory makes sense, because the argument goes “if all races are on average the same then why are some races doing better than others? It must be because of some systemic “discrimination”.”

But all races are obviously not on AVERAGE the same.

A much better explanation for the “disparate impact” is the inconvenient fact that AVERAGE black IQ is 85 vs. white at 100 and east asians slightly higher.

So, no, all races are on AVERAGE not the same!!

But everyone is afraid to state that simple, proven truth, and so we come up with these insane, societally destructive policies like DEI.

The Chinese don’t have DEI - everything is based on merit. They will kick our asses... and we deserve it!

I work in health care, and looking at the way they simply folded and knuckled under to the fallacious proclamations of the CDC, FDA, and NIH was extremely disillusioning and disgusting. If they did it our of bureaucratic inertia, laziness, and stupidity, that is bad enough. But if they did it for financial reasons, to meet vaccination goals, to force staff to get mandatory vaccinations, to increase reimbursement in some way, that is far worse.

It was one of the most profound disillusionments of my life, to see my profession act as it did.

I have always known the Medical Profession leans far to the Left, but this graphic I just saw a few days ago illustrates it well:



And there was this, that I saw a couple of years ago during the pandemic. It was one of the most profoundly disturbing things I have ever seen.

It has the look and feel of a Marxist Struggle Session, and all the students got up and recited it. I have no information on whether any entering students refused to recite it. This is the new 'Woke Hippocratic Oath":

As the entering class of 2020, we start our medical journey amidst the COVID-19 pandemic and a national civil rights movement reinvigorated by the killings of Breonna Taylor, George Floyd and Ahmaud Arbery. We honor the 700,000+ lives lost to COVID-19, despite the sacrifices of health care workers.

We recognize the fundamental failings of our health care and political systems in serving vulnerable communities. This oath is the first step in our enduring commitment to repairing the injustices against those historically ignored and abused in medicine: Black patients, Indigenous patients, Patients of Color and all marginalized populations who have received substandard care as a result of their identity and limited resources.
