I am not so sure. Using your ‘Definition’ I could make a legitimate stance that the entire Executive right now has done an insurrection. Joe Biden has used monies and people to actively and deliberately allow illegals to flood through the border violating Congressional law. No rational American would deny these facts. They would also recognize that the violence against Citizens is a direct result of that insurrection behavior. That would be proxy violence against citizens by an insurrectionists executive, using your terms.
From a historical perspective, Congress declared an insurrection during the civil war. The acts and Amendments that followed were related to that declaration. They absolutely were not independent, by time, or by causality. Riots, protests, and the like were expected by founding fathers. You can’t declare them a “insurrection” because they are over before Congress can vote to make it one.
To deprive someone of life, liberty, and the pursuit of happiness, Congress needs to declare something an insurrection ahead of said punishments levied against its existence. If this is not done, every protest can be an ‘insurrection’, and the peoples Bill of Rights suppressed.
Further, if government itself is never in danger and does not believe it was in danger, it’s not an insurrection. Congress blocked extra protection for Jan 6th and opened the doors to Congress, those are not acts of the fearful. Calling something an insurrection, especially within the boundaries of the Bill of Rights, requires Congress to define it as such or you risk undermining the Constitution.
So I am going with riot, bad behavior, protest, but not ‘insurrection’ until Congress votes to declare it as such. The 14th Amendment was written and adopted werein the ‘insurrectionists’ were previously defined and represented a very real threat (invaded). That’s the standard that should be used.
The whole point for establishing the blatantly racist BLM charade was insurrection.
The basic premise for being progressive is to create insurrection.
