A Florida teacher who was beaten senseless by a 270 pound student has refused to support a lighter sentence for the teen.
High school teacher Joan Naydich was violently attacked by Brendan Depa, then 17, in February after she told him to stop playing on his Nintendo Switch.
The autistic teen was seen on video punching and kicking the educator in the back and head until she lay on the ground unconscious.
Eventually the 6-foot-6 teen, now 18, was pulled away and restrained by other staff.
Naydich, was taken to a local hospital and treated after the assault.
Depa, reportedly threatened to kill Naydich during his arrest.
Depa, was charged as an adult and faces up to 30 years in prison for the first-degree felony charge of aggravated battery.
The teen, who was initially charged as a juvenile before being upgraded to an adult, is set to plead guilty in an attempt to avoid jail time, the New York Post reported.
Naydich has 'shown no interest in mitigating what penalties Depa might face', according to news site Flagler Live.
Depa had three prior battery arrests before the February attack and has been in a prison fight just last month, the Post reported.
'I'm hopeful that the awareness of this incident being spread far and wide will prevent anyone else from ever dealing with the trauma, physical healing and disruption of everyday life this has caused,' she said on a GoFundMe page that has raised more than $100,000.
Depa is slated to issue his plea later month and will be sentenced after that in a separate proceeding.
Matanzas High School where the assault occurred has been beset with violence in recent years, the Post reported.

Insurance (medical) takes forever to get the Provider paid. First they will expedite sending out Bills to the Patient (Victim) in hopes of getting $$$ out of them 1st. Then they'll banter back and forth with the Provider for 6-8 months over nitpicking BS charges. Then after the Insurance Company sends the payment to the Provider they will return to sending the Patient (Victim) the still outstanding balance for the things like a $18.00 Venipuncture Drainage Control System (1 Bandaid + 1 cotton ball) that's put on the location of the 04:00 daily $177.00 Venipuncture (Blood draw) for routine blood testing. Then the Lab bill for a CBC-Complete Blood Count (Tests Red and White Blood Cells), AST-Alanine aminotransferase (Part of the Liver Function Test), ESR-Erythrocyte Sedimentation Rate (A measure of inflammation) which could be in the price range of $300.00 - $800.00 depending upon the type and number of testing parameters requested. I could list many more things like that but I think You probably get My point.
Worker's Compensation- LOL !!! That's a whole different Rodeo Bull to ride. I'll go with the short version of My WC Claim adventure. Back injury from helping lift and move the door for a Safe, with another person helping. We moved it from the forks of a forklift that was at waist/bench level to the bench. Next morning I barely was able to get out of bed. Went to Chiropractor and was adjusted, received Galvanic Muscle Stimulation, told to take at least 7 days off work. Got Doc note and turned it in to the stupidvisor who told Me to fill out the paperwork for a WC Claim.
I get a call from the WC claims investigator wanting to visit Me at home (home is 48 miles 1 way from city) at the time We had several large Dogs, 1 Raccoon and I don't let corporate strangers in the house, that's why they have offices. I had a Doc appointment the day she wanted to visit so told her I could come by her office. So I went to Doc and then her office. I'm using crutches to help with some of the weight support and stability issues. I get in her office and before I am even able get into a chair she comes right out and says "you're faking this injury." I was severely offended to say the least. Well things got UGLY after that. However I stayed to listen to her BULL$}{!T which was how the WC claim is handled. While they begin the investigation they tell You the payment rate calculation formula and that the first 6 weeks will be held back and the actual checks start on week 7. Once they do the investigation IF they decide that it is a valid claim and if so then they will send the first 6 weeks of payment in with the 8th payment so you will get 7 weeks of payments in a lump sum on week 8. (I would much rather have been back at work because I could have made much more working that the $175.00/week from the "formula". But they never stop the investigation. They pay some idiot to follow you around and the guy they put on My case was about as unprofessional and unnoticeable as could be. He was about as inconspicuous as an elephant standing in a room full of mice. All the way to the beaten up pickup truck with food wrappers and empty coffee cups on the dashboard 8" thick and wing vent to wing vent. Even out in the country roads he was only about 200' behind following Us. From home to Doctors appointments, MRI's, or wherever, the grocery store and back home, every time the same route. One day We pulled into a neighborhood that was new and drove around the same 3 blocks like 6 times and HE WAS STILL FOLLOWING US !!! He probably should not have been issued a Driver's License. I had to put up with the stupidest things for several years. Hearing after Hearing with them trying to dump My claim so they didn't have to pay. They lost every attempt. I'm stopping about that now because it's pissing Me off again. Thank God I finally got to where I'm doing much better now but never really got back to 100%.
✅ Got it,Thanks and Stay Safe.🤠
See Post #62.
“If this young man is a low functioning autistic, they can have zero impulse control (like a toddler). They need to be in schools for special needs students if they are repeatedly violent without provocation or cause.”
That’s part of the problem. Too many special needs schools have been shut down and their students “main streamed” into ones that aren’t able deal with the issues they bring.
Well, he is a Teen so he is excused. Just gettin him some reparations. What is he doing in a regular class room? How did he get past 6th grade without doing something similar before? or is this perhaps not the first time?
TftP, Thanks for the Ping.
Does her input really have any impact on the sentence? This seems like a crime against the state, and would be dealt with by the justice system.
From the excerpt:
"Depa had three prior battery arrests before the February attack and has been in a prison fight just last month, the Post reported."
I know that there's a long-standing Free Republic tradition of not reading the full article, but this info was contained in the excerpt!
Regards,
Yep my
Worker’s comp won’t pay for everything.
Remember, she was beaten unconcious. I notice the excerpt didn’t describe her injuries.
They often do, but they leave it to the teachers to enforce. Then when the teacher tries to enforce the school's ban... this happens.
Exactly--just like a rabid dog, it may be sick but it's dangerous and can't be permitted to harm others. Thank goodness this hulking 'student' didn't take his rage out on an innocent kid half his size.
How would you suggest someone control a kid this size with no impulse control? Do our teachers all have to be Roadhouse bouncers, in addition to being able to teach Calculus or AP Lit? Do you know a lot of people who fit this description? Academic skills, young and fit, Delta Force training, patience of Job...?
He has absolutely no redeemable qualities. He can’t work, can’t think, can’t control himself. Heck, I’ll bet he can’t wipe his butt clean. He is useless.
Sickening to say the least. I doubt he’s autistic as well.
That’s all part of Public Law 94-142. Students must be educated in the least restrictive environment. Another law enacted by Democrats with unintended consequences.
Don’t get me wrong; my youngest son has personally benefitted from it and will be going on to a successful life. That being said, there are people for whom it will not be appropriate as their needs far outweigh the capabilities of the school district and they will always need a highly specialized environment. Most districts can’t afford it.
If they can get through his skull - lobotomy would work.
And, if true, it makes me wonder what the district has covered up...
