NY AG Seeks Ban On All Trump Family NY Business Starting Monday Trump defendants’ insurance, & financial statement fraud & conspiracy trial starts Monday
he NY Attorney General Letitia James is not content to just have the trial judge Judge Engoron rule that Trump (Don Jr., Eric and all of his key executives and companies) have committed Persistent Fraud under NY Executive Law 63-12 in all of his business dealings by inflating his balance sheet to obtain loans, and deflating asset value to get tax breaks.
And it’s not enough for the NY AG that the Judge already ordered, consistent with her powers, to address Persistent Fraud under 63-12, that all of Trump’s companies need to be cancelled, dissolved, and an independent receiver appointed over the sale of his key real estate assets.
General James smells blood, and wants more all the way to obtaining the equivalent of a “corporate death penalty” — to put Trump World out of business once and for all.
The appellate court just gave the greenlight to the Fraud Trial of the Century to start this Monday October 2, 2023, and the NY AG has told the trial court that she will not agree to dismiss any of the remaining 6 fraud counts against Trump World, including for business record fraud, fraud in preparing financial statements, and insurance fraud, and conspiracies around all of these crimes.
The reason?
The Attorney General needs to put on 30+ witnesses, including Michael Cohen and Ivanka Trump and the evidence that goes along with them, to obtain the ultimate relief she is looking for:
Over approximately $400 million in claw back monies (including interest running) to go to the People of the State of NY Lifetime bans against Trump and his sons from ever running a NY business again A ban against Trump borrowing money in NY for 5 years A ban against Trump buying any new real estate in NY for 5 years Requiring that Trump submit to having real audited financial statements for the next 5 years that he supplies to all defrauded Having a new Trustee of the NY AG’s choice head Trump’s main asset protection Trust, in which he has hidden all of his assets. If Trump thought Tuesday’s ruling finding that he committed fraud in his business practices was bad, wait until he sees what Judge Engoron is going to do next to strip him bare of his assets, company control and ability to transact real estate deals and borrow money, if he finds that the State has made its case on the lower “preponderance of evidence” burden of proof.
