Prominent conservative legal scholars are increasingly raising a constitutional argument that 2024 Republican candidate Donald Trump should be barred from the presidency because of his actions to overturn the previous presidential election result.
The latest salvo came Saturday in The Atlantic magazine, from liberal law professor Laurence Tribe and J. Michael Luttig, the former federal appellate judge and prominent conservative,

“The people who wrote the 14th Amendment were not fools. They realized that if those people who tried to overturn the country, who tried to get rid of our peaceful transitions of power are again put in power, that would be the end of the nation, the end of democracy,”
-snip
Not all in the legal community agree with the pair’s constitutional argument – and what the scholars are proposing would need to be tested in court.
Yet Luttig and Tribe’s writings capture a conversation about the Constitution and the 2021 insurrection that is likely to grow heading into the 2024 election season.
They and others base their arguments on a reading of part of the 14th Amendment, a post-Civil War provision that excludes from future office anyone who, previously, as a sworn-in public official, “engaged in insurrection or rebellion … or [had] given aid or comfort to the enemies” of the government.
The pair write: “Having thought long and deeply about the text, history, and purpose of the Fourteenth Amendment’s disqualification clause for much of our professional careers, both of us concluded some years ago that, in fact, a conviction would be beside the point.
“The former president’s efforts to overturn the 2020 presidential election, and the resulting attack on the U.S. Capitol, place him squarely within the ambit of the disqualification clause, and he is therefore ineligible to serve as president ever again.”

Legal scholars? This is like the “experts” on global warming or how safe and effective the Covid vaccine is. When a liberal uses terms like this, it’s supposed to end the discussion. It clearly means they have deferred reasoning and logic to the sanctity of those who know more than everyone else, especially Christians or conservatives. It’s saves liberals from any questions or exercises of intellectual analysis. It’s the Dunning-Kruger effect in action.
If the 14th Amendment applies to Trump, then it also applies to anyone who threatens the Deep State.
Me: For the country to survive, things have to drastically change.
Deep State: You’re inciting rebellion! You are therefore barred from all elective offices.
But a corrupt Democrat whose family has taken millions from his countries enemies deserves to finish and also serve another term is AOK?
Speaking of our two tiered justice system...whatever happened to the Joe Biden and Mike Pence classified documents investigations? It was 24 hour news coverage when the feds raided Mar-a-Largo.
Lawyer Tribe is a Democrat misanthrope who hates all Conservatives. Luttig is the cowardly clown who hid behind Pence’s skirt when Trump was calling the election into question.
political hacks say what?
It’s become ever more apparent that our country has the resources, power, and ability to achieve any result, outcome, or event that they choose. Complain about it if you must. Be outraged, and demand that someone should do something to hold these corrupt tyrants accountable. Like Parisians complaining about the Nazis ruining their fair city in 1940, there may be little recourse other than to wait for the shooting to start.
LOL because they know he is going to win and no fake virus that they create can stop that..gee, can we impeach Biden for all of the crimes he committed such as creating MULTIPLE email addresses in order to sell America to the highest bidder

When the government considers the “people” as enemies we
are not in Kansas any more.
One only needs consider a majority socialist supreme court
to understand the consequences of such a stance!
That was the same era where there was “attorney-client privilege”. Then Trump happened.
Patriots should permit no voting at all in any jurisdiction where Trump is kept off the ballot.
Riiiiiiiiiiiiiiiight. /s
So, according to these legal “scholars” it is the charge that is important, not whether a person is guilty or not. That is the typical democrat position when it comes to a Republican. Well, why not, it worked against an Alaska senator and a Texan representative. We have no legal system in this country any more.
TRUMP 2024
We the People’s choice.
Scholars? Seriously? Those two has beens don’t have enough brain power left to light a fire.
Tribe! LOL!
The word “increasingly” in the headline is the blatant lie. The only thing that’s “increasing” is CNN asking leftists what they think about the eeeevvvvil Trump.
First of all, no real conservative would have any dealings with THE ATLANTIC. Secondly, being a cynic about most things associated with Washington and the eternal quest for omnipotence is, “What’s the payoff for them personally?”.
Lying media predictive programming for what the leftists are actually trying to do in the states where he’s targeted...make him ineligible to be on those swing state ballots.
The real motive.
Stalin would be laughing
“Prominent conservative legal scholars are increasingly raising a constitutional argument that 2024 Republican candidate Donald Trump should be barred from the presidency because of his actions to overturn the previous presidential election result.”
First sentence has five embedded lies, based on a not very attentive cursorily glance:
1. Prominent legal scholars
2. Prominent conservative scholars
3. Scholars
4. Barred from presidency
5. Actions to overturn election
