The co-trustees of a trust in the name of Richard Blum — the deceased, wealthy husband of Sen. Dianne Feinstein — were accused of elder abuse against Feinstein in a recent court filing submitted by her daughter, Katherine, who has limited power of attorney over the senator.
The filing, submitted Aug. 8, partially confirmed what had previously been reported by other outlets: that Katherine Feinstein, a former San Francisco County Superior Court judge and current San Francisco fire commissioner, has limited power of attorney over her mother, which the senator signed over to her on July 23, 2023. The recent court filing notes that this entitles Katherine to make legal decisions for her mother in certain civil-related matters.
In the Aug. 8 filing, Katherine Feinstein made the striking allegation that Michael Klein, Marc Scholvinck and Verett Mims, who control the disputed trust, are committing financial elder abuse against the 90-year-old senator. California’s elder abuse laws cover all state residents age 65 and older.
In the filing, Katherine alleges that the co-trustees didn’t fund a trust her mother is the sole income beneficiary of and that they have not made “required distributions” to the senator since Blum’s death in 2022. Katherine, Feinstein’s daughter from a previous marriage, also alleges that the co-trustees are purposely slow-rolling payments to the senator because they “intend to benefit Richard Blum’s [biological] daughters, who stand to inherit millions of dollars that should go to Senator Feinstein if the Trustees never make the required distributions to her.”

Who has power of attorney over her Senate votes? If she can’t run her own affairs how can she competently cast a vote?
My daughter has had Power of Attorney for years...but I'm still doing just fine....and right now....she has "0" power to do anything.

DiFi’s grant to her daughter of power of attorney requires that DiFi be competent at the time of the grant. It does not indicate that she is incompetent, although the power of attorney could be challenged for being ineffective because of DiDi’s lack of capacity AT THE TIME OF THE GRANT. If the power of attorney is durable, and if DiFi was competent at the time of her signing, the power of attorney will continue to be effective even if DiFi has become or subsequently becomes incompetent. In any case, DIFi is still able to executer documents and make decisions on her own behalf. The power of attorney does not affect that ability. Too many armchair lawyers in this crowd.
Better check your power of attorney. If it is immediately effective (when you signed it, your daughter may act on your behalf right now. If it is a “springing” power of attorney and becomes effective only when you have been determined to lack legal capacity, your daughter cannot do anything on your behalf until your lack of capacity has been established.
Her staff makes her decisions for her.

Being an invalid does not kick in a Power of Attoreny. You need to learn about a POW, what's in them and how they work.
If you are incapable mentally or physically to point of not being able to conduct legal business and sign contracts, what would come into play other than a power of attorney, to allow someone representing you to transact your business?
the reality is that Americans across the country are experiencing elderly abuse at the hands of these octogenarian legislators who REFUSE to budge for younger legislators. there should be mental acuity tests for these elderly CONgresscritters.
My bank accounts are joint with my daughter. No power of attorney necessary. She can pay my bills etc etc..or close it out in the event of my death.

A Senator who is so mentally incompetent that her child has been given power of attorney over her should resign from the Senate.
