Neither Charles nor Queen Elizabeth could assert custody of Harry's children when they were born until Elizabeth died.

According to reports, the royal family operates with a strange custody agreement when its couples have their children, which states that Her Majesty Queen Elizabeth II has full legal custody over the young royals.

Harry is a Royal. Meghan is an American citizen residing in California. If she goes to a California divorce court and demands custody, it could get messy, up to the Supreme Court.

If the daughter is an American citizen born in the US to an American citizen who is currently residing in the US,

then I doubt a California judge will give a DAMN what the Brits and the State Dept say.

Harry is a Royal. Meghan is an American citizen residing in California. If she goes to a California divorce court and demands custody, it could get messy, up to the Supreme Court.

People want custody settled soon, so kids can go to school. In this uniquely international situation, the best a California court can do quickly is a temporary order of custody until there is a long, drawn-out hearing. A SCOTUS case takes years to get there, and it depends on whether the SCOTUS would even take such a case. They hear a very small percentage of cases sent up to them, at their discretion.

Does our Supreme Court even have standing in an international custody dispute? The highest this matter is likely to go is the US & UK diplomatic corps.

The other issue is distance. Obviously H&M will not be able to have frequent shared custody unless one of them repatriates, and it ain't gonna be Sparkles. Given that both parties will assert that they are the rightful custodian, what could she do, change the locks and hire bodyguards to keep Harry out? Harry could just bundle them up and fly home, and make her fight it out for year$ and year$. He has more power in this situation, barring other complications such as the children not actually being full blood whereupon the royal family decides to ditch the whole mess.

It will indeed be interesting, but I wouldn't count on either H or M feeling overly impressed by California law. Many of the Hollywood divorce suits are negotiated by ther parties' publicists and tried in the media. Some Hollywood divorces, like Brad and Angelina's, last seven to ten years. While neither Harry nor Megxit has the attention span to keep fighting that long, there are plenty of royal courtiers on staff to keep it going for Harry, Charles and William's side. Charles himself may not last that long.

If it comes down to William, I doubt he would dither around. He will be king; he is a good dad, has three playmate children to offer Harry's kids (and also cousins of playmate age), and he would be Harry's only close family after Charles is gone—whereas Meghan's father's large family will testify against her! At a minimum, Charles or William will have those kids back in UK to go to boarding school, and she can have a couple of weeks in the summer, supervised by MI6.

There are so many more avenues open to the Crown to manage this situation than are there for the family-free Meghan, who spurned everyone she grew up with except her mother. To whom would you award the kids—California semi-ghetto, or the large royal family of a thousand-year monarchy, in which both children are in the line of succession and need to be educated in its traditions or be removed from the line?

Even Diana lost primary custody.

Missing: Mia Tindall (oldest child of Zara), Archie and Lilibet Mountbatten-Windsor (Harry's children), August and Ernest Brooksbank (Prince Andrew's grandsons by daughter Eugenie).

Megan really doesn’t care about the children - they have simply been an instrument she can use, like Harry - and that she will do. If Harry does acquire the children she will of Course play the ‘victim card’ she always utilizes when boxed in a corner she doesn't have the brain power to figure out that she is the one to blame for her problems.

Also she will blame Harry for the breakup.

However this game she plays goes her moves will always be how it will benefit her. As for the press - she loves the good and the bad - as long as the attention and camera is on her she knows the world is watching HER...and she will arrange it so you are.

So true — Mrs. Harkle is a user. She used her father’s connections to Hollywood to become an actress, then threw him under the bus when he was no longer useful to her. She disowned both her father and siblings, thinking they were beneath her now that she was a “princess”. Who knows how many other people she used on her way up, including her first husband. (By the way, has anyone ever talked to him about their marriage?) She got her hooks into Harry when she saw he was dazzled by her “celebrity” and fed and encouraged his neediness to the point he thought he couldn’t live without her. Folie a deux. Mrs. H thought she would be a princess and live the life of luxury in a castle, doing nothing but bossing the help around and having tea. What a surprise when she and Harry had to live in a “cottage” and not Buckingham Palace! She had no idea there was actual work involved in being a “royal”. When she found out she was going to have to actually work in a structured environment, she wanted out, and convinced poor Harry that he was abused and should reject his family and flee to the US where they would be welcomed with open arms by her friends in Hollywood where they understand misunderstood people like them. Boo-Hoo! She also thought airing their grievances in both a book and in a video would make them rich beyond their wildest dreams, and they could continue their privileged lives unabated. Well, that seems to have backfired. I hope Mrs. H gets everything she deserves — in a karmic sense.

After his book and interviews about his family? Not to mention Oprah as his grandfather was dying. IMO I’d want nothing to do with him, and definitely couldn’t trust him.

I’d give him the governorship of Saint Helena for a few years.

If he did well there. Meaning he did nothing to make the news.
Then he can come back for maybe a posting in the Shetlands.

She was never an A list actress, more like B or C, her only noteworthy role was on the the TV show Suits, other than than nothing else really. I am not sure she would even be wanted as a character actress at this point.
