Today I offered an amendment to the NDAA that would have clarified that Article 5 of the NATO treaty does not supersede the constitution.

It should have been an easy vote to affirm the Constitution, to vote against affirming the Constitution actually places doubt in the Constitution. But it was defeated 83-16.

Is it congresses right to be waived or is it their obligation under the construction. The war fools who thinks only article 5 will supersede the constitution are naive. The country will be run by external bureaucrats if this bunch isn’t pushed aside.

The Constitution was superseded by the Civil Rights Act.

The Civil Rights Act is the Successor Constitution

I never said that Senator Paul was legally incorrect. I said that his legal correctness is likely to lead to an unintended bad result, war. Men like Putin and Xi are ruthless opportunists, and if they think we won’t fight they will invade. It’s better not to leave any ambiguity in their minds.

It could be argued that NATO is no longer in effect, because the entity that it was created to go to war against NO LONGER EXISTS.

You have it backwards. I want the ambiguity to be in the minds of other NATO nations. They should never feel free to run around doing whatever they please, content in the knowledge that we think we are obligated to go to war whenever they choose.

Congress can waive its authority if it votes to do so, as it has done numerous times over the years by transferring powers held by Congress over to the administrative state or the Executive branch.

As for NATO Article 5 superseding the Constitution, that is precisely why Rand Paul brought up the issue: For clarification.
