The motorist who allegedly mowed down a pick-up truck driver who slashed his tires during a road rage clash on the Upper East Side has been charged with manslaughter, police said Thursday.

Andre Mosby, 26, was driving a 2014 Volkswagen Jetta on East 60th Street near Park Avenue when he and Roberto Velez Alvarez, 54 – driving a 2020 Chevrolet Silverado pick-up truck – got into a smash-up around 2:15 p.m. Wednesday, police said.

The two men started arguing, and the feud quickly escalated, police said.

I dont know the particulars of this case, but if a person is violently attacking your vehicle with an instrument or a weapon, they are displaying a behavior that puts the other person at risk of injury.

Think of someone who grabs a tire iron or bat and smashes the window. Is it reasonable to assume that the person’s rage is going to just stop with the window?

I would have a hard time convicting.

“Mosby lives in Midtown Manhattan, cops say. He has a number of prior arrests including one for robbery in the Bronx in 2017 in which he was accused of punching a man and stealing money from him. Most of the other arrests are sealed.”

The reporting on any situation in NYC involving the Amish is so bad that it is hard to say what actually happened. But one person in this situation had a long and violent criminal history starting when he was a child, the other who is dead and cannot defend his actions had no criminal history.

In my country, Kentucky, if someone is threatening your life or serious bodily harm, you are within your legal rights to use deadly force to stop them. Most people interpret that as a right to shoot them, which it does. But running them down in a car is also using deadly force to protect yourself and those within your charge.

I can tell you that if, instead of running him down, he had pulled out his legally carried gun and shot the man dead, that would pretty much end the story, at least in my country.

I wouldn't lose a lot of sleep over this.... The Manhattan DA would rather cut off his own arm than actually convict one of the protected classes.

My guess is that none of the reporting on this is accurate... This is likely the dead guy.

There are no pictures of the person arrested which means he is most likely not a white male. I am skeptical of all the reporting in this situation. The person who is dead who had no prior criminal history is obviously being villainized.

The person with a violent criminal history going back to childhood who police say hit the gas, pinning a 54-year-old man up against a café window and then driving through it is being portrayed as someone "protecting his kids. Let's see a picture of the knife. Supposedly the pickup being driven by the now dead guy wouldn't "let the car in", so the poor violent criminal was forced to bash into the pickup with his car to make his turn... Something doesn't add up.

CPR, done right, is vigorous. It can break bones and cause severe bruising. If it’s not done with extreme vigor, it’s useless. Just don’t break off the xiphoid process ...

Red Cross currently recommends against rescue breathing.

Here is an article with a little better description... And supposedly there is surveillance video. Who knows if the picture is actually of the two guys... but it led to the article. I would bet more that the deceased person is the person in the picture I posted previously.

Manslaughter charge in wild Upper East Side road rage clash sparked by fender bender

"A driver accused of intentionally running over a motorist who had just slashed his tires during a wild road rage clash sparked by a Upper East Side fender bender has been charged with manslaughter, police said Thursday.

Andre Mosby, 26, is also charged with assault for the crazed confrontation that unfolded on E. 60th St. near Park Ave. about 4 p.m. Wednesday.

The mayhem was set in motion by what police called a “love tap” between a gray Chevy Silverado pickup driven by Robert Velez-Alvarez, 54, and the gray Volkswagen driven by Mosby, who had his girlfriend and three children in the car with him, police said.

“It was a scrape,” said the source. “It was a love tap. You could barely see the damage.”

But it was enough to set off Velez-Alvarez, who jumped out of his Silverado armed with a knife and started stabbing the rear tires of the Jetta, according to police and surveillance video seen by the Daily News.

Velez-Alvarez then rushed to the front of the Silverado to confront Mosby.

That’s when Mosby allegedly hit the gas and ran Velez-Alvarez down, hurling him through the front window of the Oxford Cafe, police said, then pinning him under the car.

Tailor Jorge Hernandez was returning to his shop above the Oxford when he witnessed the attack.

“He was yelling at the guy under the car,” Hernandez added. “[The victim] was under the bumper from the chest down. He was still conscious. He was trying to reach for his cellphone.”

Good Samaritans helped lift the car off Velez-Alvarez. Medics rushed him to New York-Presbyterian Hospital Weill Cornell but he could no be saved.

Mosby was quickly arrested, with his three children — girls, ages 8 and 6, and a 4-year-old boy — taken to the same hospital as the victim as a precautionary measure.

“It was crazy,” Hernandez said. “I’ve never seen anything like it.”

Kamel Osbourne, 26, a friend of the Mosby, said the suspect was just trying to protect the kids.

“It was in the heat of the moment,” Osbourne said outside the 19th Precinct stationhouse. “[Velez-Alvarez} had a knife. There were kids in the car.”

Osbourne said Mosby’s girlfriend told him her boyfriend was driving her to work at her restaurant job when the pickup truck driver refused to let them into his lane.

“This guy wasn’t going to let them merge,” Osbourne said. “He was for sure not going to let them in.”
