FBI Joins Investigation into Alleged Sex Assault of 6-Year-Old Girl in NW Texas School

Officials with the Plainview, Texas, Independent School District announced they are working with the FBI and other law enforcement agencies regarding the alleged sexual assault of a six-year-old girl in an elementary school. An IT staff member reportedly discovered a video of the attack on a school iPad.

In a statement from the Plainview Independent School District (PISD), officials stated:

Plainview ISD and local law enforcement are now working with the FBI regarding the incident that occurred at South Elementary. We appreciate the support of the FBI and of their resources to evaluate the multitude of circumstances surrounding the incident. Furthermore, the police investigation has been submitted to the Hale County District Attorney’s Office for evaluation.

The district also canceled classes on Monday and Tuesday due to threats of violence regarding the handling of the incident by school officials, EverythingLubbock.com reported.

The incident came to light in April when the little girl’s family noticed her having nightmares and refusing to go to school, MyHighPlains.com reported. This led to the discovery of an incident that reportedly occurred on April 18 when some recorded the girl being force to perform sex acts under a desk in the classroom.

FR: Never Accept the Premise of Your Opponent’s Argument

Is FBI responding to a request for assistance from local law enforcement?

Given this case of domestic violence, even if an illegal immigrant is suspected, if popularly elected state government legislature or governor did not formally request assistance from the FBI, then the FBI's involvement in this case is unconstitutional imo.

"Article IV, Section 4 (4.4): The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence [emphases added]."

I surmise that the people on both sides of request for assistance do not know the federal government's constitutionally limited powers and have consequently unthinkingly help to expand the powers of the already unconstitutionally big federal government by involving the feds.

The creation of child pornography is a FEDERAL CRIME, PERIOD.

Distribution of child pornography is a FEDERAL CRIME, PERIOD.

This is why the FBI is involved in this, or any other case that involves child pornography.

The FBI is not investigating the ongoing sexual assault crime. The FBI is investigating people upset by the lack of action by the school district. It’s another ‘counterterrorism’ operation aimed at protecting bureaucrats who allow children to be victimized.

Thanks for replying HamiltonJay.

Respectfully HamiltonJay, the states have never expressly constitutionally given the feds the specific power to police child pornography.

"From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]." —United States v. Butler, 1936.

In other words, in order for the feds to constitutionally protect the kids from such abuse, the Constitution needs to be appropriately amended instead of allowing the feds to overreach their constitutionally limited powers.

On the other hand, even if the feds had the express constitutional power to criminalize child abuse, what "magic wand" do the feds have to do deal with child pornography that the states can't do with their 10th Amendment powers?

Yes, even conservatives like to threaten crooks with the big, bad federal government. But the cost of unconstitutionally big federal government is arguably worse than any other crime.

Respectfully, these laws have been challenged all the way to the Supreme Court and upheld, and long after the 1936 ruling you wish to cite as ironclad proof.

Your stand is not upheld by law.
