The question before the court was whether the phrase “obstructing, influencing, or impeding an official proceeding, in violation of 18 U.S.C. § 1512(c)(2)” warrants charging those who peacefully walked through the Capitol with felonies.

The decision by the U.S. Court of Appeals for the District of Columbia means that the charge -- the obstruction of an official proceeding before Congress -- can continue to be used in the Justice Department’s prosecutions related to the Jan. 6 riot. It could also ultimately be used against Mr. Trump should the special counsel, Jack Smith, decide to file a case against him related to his efforts to overturn the 2020 election.

But even though the three-judge panel, in a 2-1 ruling, left in place the status quo and temporarily avoided crippling hundreds of Jan. 6 cases by invalidating the obstruction count, it still presented a serious challenge to the Justice Department moving forward.

A provision of the law requires proving that any interference with a congressional proceeding be done “corruptly.” Two of the judges said they were inclined to define that term in a narrow way as receiving a personal benefit -- even though the panel as a whole put off a final decision on the issue. The split decision left wiggle room for defense lawyers to try a flurry of complicated new efforts to invalidate the charge...

There are some who damaged property. There are some who might have injured others. But most people who were there were,at most,guilty of simple trespassing. And given the videos we've just recently seen of people being guided by police officers through the halls in a calm,orderly,fashion it's clear that many can't even be charged with simple trespassing.

But Rat Party Headquarters continues to cry "Pearl Harbor!"...."9/11"...

Ironically, it was the auntie fas and the feebs and other alphabets (Epps) who were trying to disrupt the proceeding in a corrupt manner. The ones charged who were actually charged were the parading retards who allowed themselves to be herded by the deep state operatives.

The Capitol Police were clearly holding the doors open when a couple hundred demonstrators peacefully walked around the Capitol Rotunda for an unknown period of time.

My personal theory - less than 50 people actually entered restricted areas of the Capitol.

My personal speculation - 25 of those 50 people were FBI informants or paid provocateurs.

When the FBI actors took down the orange plastic fence around the lawn that marked the 'trespass' zone, it was no longer 'trespass', it was 'entrapment'.

For this the DOJ and FBI should suffer an IMMEDIATE loss of the top 26% of leadership, with an offer of 'no retirement, no charges'. Put their retirements into the Soc Sec Trust Fund.

Exactly! If you came to DC on J6 for the specific purpose to overthrow the government, would you have spent your time removing the fencing around the secured zone. No. But paid employees of the Deep State would have and did. Those paid employees were in place and waiting for the command to remove the barriers and did so when the order was given. This can be seen in the videos.

This bears repeating. Who benefited from this whole, clearly choreographed, charade? The Dems and their supporters in the Fed.gov. No more analysis of causative motivations is needed.
