Relatives of a Ms Nakajjigo initially sought $140m in damages from the US government. The $10.5m decision came after a wrongful death trial in Salt Lake City for the philanthropist who was tragically killed on a camping trip with husband Ludovic Michaud on 13 June 2020, the Associated Press reported.
Attorneys for Ms Nakajjigo’s family argued that the US National Park Service were negligent for not securing a metal traffic control gate that whipped around in high winds and sliced through the car’s passenger door, instantly killing her.
US attorneys don’t dispute that park officials were to blame. But they argued that the damages initially sought based on Ms Nakajjigo’s future earning potential was too high, and that a figure of $3.5m would be appropriate.
The claim filed on 22 October argued that her death could have been avoided if the gate had been installed correctly or if it had been locked in place to prevent it from moving in the wind.

Loss of earnings and loss of earnings capacity damages have long annoyed me for that reason. A single statutory value of life — maybe even as much as one million — should be the standard.
High earners have the wherewithal to insure themselves and should do so, rather than passing the loss on to society at large. (Which directly or indirectly is what the current system does.)

The “Ghetto Lottery” is also a well known money maker for the families of many societal losers who fail to comprehend and obey police orders.
Look at the now rich families of Trayvon, Michael Brown of Ferguson, Freddie Gray of Baltimore, St. George of Fentanyl and so many others. The latest winner will be the family of Tyre.
Will they also collect a $10,000,000 payout? Will it be worth it, to win that at the price their son chose to pay, his life?

My “business” insurance (just myself) has doubled to $20,000 a year because of this kind of stuff. My agent said in the previous 20 years the most he ever saw for a claim was $1 million, and it was for a death.
He told me he just had a claim of $3 million for a guy that tripped on a crack and damaged his knee which would impair him (but not stop him) at his job as a home builder!
