She was born on US soil. She is a citizen by birth. Her parents status does not negate that fact...being that she is natural born.

Neither of my grandmothers ever became citizens....nor did they ever speak English.

‘Native born’.. a ‘natural born citizen’ has always meant born to citizen parent(s).

‘Natural’ in law has always meant ‘from the body..’ as in a ‘natural son’ is a person who came from the body, regardless of church sanction.. that is ‘a bastard.’

Thank you for this post. She’s clearly a citizen by nature of the fact she was born in Bamberg, South Carolin in the US. Everyone here can dislike her politics and that’s fine, but she is certainly a citizen, just as my great grandfather was, despite the fact his parents came from Germany.

The 14th Amendment is pretty clear on this.

In legal terms, a natural born citizen is a citizen who didn’t have to be naturalized in order to become a citizen. Since Nimratta did not have to go through a naturalization process, she is a natural born citizen and this issue becomes moot.

Nikki is not a Natural Born Citizen. There’s more to it than being born within the confines of the United States.

You could not be more wrong ‘We the people are government. Only US citizens birthing their child on US soil constitutes natural born citizenship. The soil does not alone bequeath natural born standing. Humanity since the garden party have always tried to fix what is not broken.

Somrone born in USA is not necessarily a natural born citizen, even if ( as is usually the case) they’re American citizens.

The term natural born citizen is a legal term of many centuries’ scholarship. And It definitely does involve parental citizenship.

Fyi.

A citizen and an Article 2 Section 1 natural born Citizen are not the same thing. Haley doesn’t qualify.

As I've posted before, I believe that the intent of the Constitution, using its own language, was that "natural born citizens" are the posterity of We the People.

The Preamble to the Constitution, which stated the Framers' intent, says that the Constitution was "ordained and established... to secure the Blessings of Liberty... to ourselves and our Posterity."

"Ourselves" means "We the People," the citizens of the United States who established the Constitution and delegated our powers to the states and the federal government.

"Our Posterity" means the children born to We the People, the citizens of the United States.

The "Blessings of Liberty" means that only the Posterity of We the People can ensure Liberty by being allowed to hold the highest office in the land. No other office in the Constitution has this requirement, meaning that the offices of representation are open to all citizens, but the executive office is limited to the Posterity of We the People.

Resident aliens are not "We the People," as they are not citizens and cannot vote for Representation in the House. Therefore, the children of resident aliens are not the "Posterity" of "We the People."

Since resident aliens are expected to be here for a long time, it is reasonable to assume that they will have children. Their children may be born here, but they are not citizens descended via parentage, as their parents are still citizens of their home countries. They are not the Posterity of We the People.

It gets even murkier when the parents aren't even resident aliens, but people on temporary visas, such as tourists, students, and specialty or seasonal workers (L1, H-1B, H-2B). These people had no legal expectation to remain here, so their children born here should have no legal expectation of being natural born citizens here. They are not the Posterity of We the People, but the offspring of passers-by.
