On January 18, 2023, the United States filed its Complaint and proposed Consent Decree to resolve allegations that Cumberland County, Tennessee violated Title I of the Americans with Disabilities Act by denying a corrections officer a reasonable accommodation and constructively discharging him based on his disability of opioid use disorder. In addition, the County implemented a policy that prevents people who are taking legally prescribed controlled substances or certain medications from having those substances or medications present in their system while at work for the County, thus prohibiting working for the County while taking such medications. Under the Consent Decree, Cumberland County will implement non-discrimination policies and procedures, train its staff on the ADA, and pay a total of $160,000 to the complainant.

My cousin used to live there until he died. He told me there was a lot of meth and oxycontin use up there on the Cumberland Plateau.

Let’s follow this logically. Why should someone who is on opioids be kept from flying a 747 passenger jet? Or being a train conductor? Or school bus driver?
The country is well on its way to being sharply divided into two parts: 1. those who never work but live off the work of group 2.
2. the people who work and whose earnings are seized in the form of taxes to pay the way for group 1.
Group 1 already hates group 2. Group 2 gets thrown in jail for saying anything negative about group 1.
The eventual outcome of this is that both groups become poor and miserable, while the ruling elite live high off the hog as they despise both groups.

The way this case reads the answer to your question is, yes.
This applies to legal prescriptions. Of course, Heroin can’t be legally prescribed.

A business gets cheaper Worker’s Comp insurance if they comply, so most do.

There are a few hidden assumptions in that post.
The biggest one is “original intent”.
Whose original intent—yours? Some of the writers of the legislation? Some of the lobbyists for the legislation?
I would argue that there were some dark actors behind the legislation that knew full well the havoc it would cause—and they had “original intent”.
I was part of writing of the original legislation in mid to late 1980’s. Much of the original legislation was aimed at mobility issues and the focus was much more narrow than the broad current laws which has been added to and bastardized by politicians.
As an example, the handicapped parking laws were originally intended for those of us that use wheelchairs full time, but over time the gray panthers screamed loud enough that many changes were made in all states that allowed virtually anyone to use HP. Now, most LE find the law so hard to enforce that no one does so. In fact, I hear from very reliable sources that Walmart forbids local LE from issuing citations in the parking lots.
The ADA, like HP, is a mere shadow of its original content.
Understood, but “mission creep” is how homo sapiens rolls—and dedicated leftists understand that if they can just get the camel’s nose under the tent they can eventually destroy the tent.
That is why the first instance of the “good idea” has to be stopped—even when it seems like a good idea.
