Federal prosecutors declined Tuesday to seek the death penalty for the alleged Walmart shooter who killed 23 shoppers in an El Paso branch of the store in 2019.
The decision is consistent with the Department of Justice’s practice of not pursuing capital punishment in federal cases since President Joe Biden took office, according to local reports.
Patrick Crusius is accused of driving 10 hours from Allen, Texas and casing the busy Walmart to make sure it was filled with Hispanic people before gunning down 23 shoppers with an AK-47 and injuring 22 others on Aug. 3, 2019.
In a hate-filled manifesto posted online moments before the attack, the now 24-year-old complained of a “Hispanic invasion of Texas,” writing that he was “simply defending my country from cultural and ethnic replacement brought on by an invasion,” prosecutors claim.
The shooting came during a busy back-to-school shopping day at the store — a popular destination for residents of Ciudad Juarez in Mexico, just across the US border from El Paso.

So why not charge the guy under Texas law?
A jury in El Paso, Texas will certainly see to it that he is executed.
Biden leftist pos.
If found guilty and the prosecution doesn’t seek the DP does the jury have the option of recommending it? And if they do does the judge have the option to sentence him to die?
My wife and youngest daughter had just left that parking lot before he started.
Fry him.
He’s STILL alive?
That’s true...I forgot about that. The courts have ruled that it’s not “double jeopardy” to be tried for the same crime in a state and a Federal court.
Re: Try under Texas law
My first question, too.
Second question - how do the Feds have jurisdiction? Hate crime violation? Do any federal hate crimes even carry the death penalty?
He is charged with Capital Murder by the State of Texas.
Life in Prison or Death.
There is no other option.
fixed it
The Feds also charged him with "Domestic Terrorism," which does carry a death penalty.
The difference between Texas 1919 and 2019, he would have been hanged by the weekend. In 2023 will give three meals a day, free TV, free medical/dental for the rest of his life . . .
So I guess he’s being prosecuted by the state and the Feds.OK...Texas will execute him even if the Felon-In-Chief won’t.
Federal prosecutors will remand him to the State of Texas for trial on Capital Murder charges, which will end up with the death penalty.
Because he’s probably one of their DS MK-ULTRA wind-up toy zombies.
They probably had a lot of time and money invested in creating that monster.
That’s ok...we’ll get to fry his sorry azz right down here....FJB.

In his manifesto, the shooter explicitly exonerates Trump from any responsibility for the shooting.
The shooter was treated with anti-psychotic medication after his arrest.
His legal defense team may plead insanity.

Georgia used to have a state law that a person couldn’t be tried in state court if they’d already been tried for the same acts in federal court. (But the federal court could take another shot at them if they’d already been tried in state court. I don’t know if that’s still the law. And I certainly don’t know if there’s anything similar in Texas.)
In high school he was in a club for students interested in a career in law enforcement.
