Repeat offender sentenced to 20 years in prison for killing Guiying Ma in NYC rock attack

The Brooklyn man who killed Guiying Ma has been sentenced to 20 years in prison.

Elisaul Perez, 33, picked up a large rock and struck the 62-year-old twice in the head on Nov. 26, 2021. The incident occurred while the senior was sweeping outside her home near 38th Ave. and 97th St. in North Corona.

Ma wound up in a medical coma before succumbing to her injuries on Feb. 22, 2022.

The brutal attack helped fuel protests against anti-Asian hate amid the COVID-19 pandemic.

Perez, who has 11 prior arrests, pleaded guilty to first-degree manslaughter last month but was not charged with a hate crime.

He was sentenced to 20 years in prison on Tuesday. His time in jail will be followed by five years of supervised release.

“While today’s sentence cannot make up for this heartbreaking and senseless loss of their loved one, I hope that it provides some measure of solace to the family of Ms. Ma,” said Queens District Attorney Melinda Katz.

“The long sentence will hold the defendant to account for an unprovoked attack that robbed the community of a beloved member,” she added.

Ma’s husband, Zhanxin Gao, who has returned to China, said he still cannot accept his wife’s death.

“It was all too sudden that our life in New York City came to an end,” Gao wrote in a statement read by Jennifer Wu, a pro bono attorney who has worked with Ma's family. “I still can’t accept the sudden death of my wife. I’ve seen violent attacks on old people in the news, but I was overwhelmed when it really happened to me.”

Unless there are extenuating circumstances, if you take
another person’s life, you should never expect to enjoy
your own again.

Put the person in prison and toss the key.

This person will be given time off for good behavior.

The dead person remains dead.

The only people who get a hate crime charge are White
males.

This is a travesty of justice.

Yes. Twenty years in prison for murder is an outrage. One of the worst things that has happened in this age is how we’ve begun to treat capital crimes like ordinary ones... that is going to come back to bite us. We need to go back to strict death penalty for 1st degree murder and for aggravated rape. People who commit those crimes don’t deserve a second chance and shouldn’t get it.

He had 11 priors, but nobody saw in him a man ready to go
out of control and kill.

I know there are some problems with the three strikes
system, but this is not the answer to that.

Career criminals need to be taken off the street. It’s
that simple.

pleaded guilty to first-degree manslaughter

He attacked the woman and bashed her skull in with a rock. How is this not murder? Lazy prosecutor wanted to chalk up an easy conviction on his record without even going to trial. This scum will be out by the time he is 45, maybe 40, and still a young man able to continue his violent life of crime.

I believe many of these irrational crimes are the result of drugs knocking out the decision making centers of the brain. I believe anyone showing irrational behavior should be immediately drug tested.

The one objection I can think of is that if you make aggravated rape automatically a capital offense, then you create an incentive for rapists to just kill their victims as a matter of course. They’d face no worse penalty for doing it, and they eliminate the key witness.

I’m not sure... I suspect going away for 20 years could be as much of a motive for murder, probably why many rape victims are killed. How many more would refrain from even the thought of the act if they knew it would result in their death? Good questions though...

A primary purpose of prison should be the prevention of revenge attacks. Asians, in particular, should be willing to recreate “fraternal organizations” to carry out revenge, like the Chinese Tong gangs of the late 19th Century.

The Tong had salaried soldiers, known as “boo how doy”, whose weapon of choice was the butcher’s meat cleaver. Because they were racial in origin, they were very hard for the police to crack.

Today, if some thug, mentally ill or not, attacked a Chinese person, especially an old person, unless they were quickly arrested, they would soon get a visit from a couple of tough guys, which would be a permanent end to his violent mischief.

And it’s not limited to Chinese, but Japanese, Korean, and any other country that has organized gangs willing to carry out acts of revenge, it would do much to balance the score.

Katz beat the Soros candidate in the Dem primary by a hair. 0.1% of the vote. Obviously revolving door policies for hardened criminals are as popular in Queens County as they are in New York County. She is likely responding to her near defeat (as the incumbent in 2019) in that primary by mirroring her opponent’s policies. A near majority of Queens Democrat primary voters supports those policies.

I misspoke. I remember Katz’s name from the papers and thought she was the incumbent. Turns out she was Queens Borough President, but term-limited out.

You might be surprised just how many are on psych meds. Despite all the PR these meds increase insanity and violence. It’s on the labelling.
