As soon as the campaign part started the band should have packed up and hit the bus. Until they are actually participating in the campaign, they are not in violation of the Hatch Act.

“All members of the armed forces, including active-duty members, members of the reserve components not on active duty, and retired members are prohibited from wearing military uniforms at political campaign or election events.”

(4) Armed Forces units may not be authorized to participate when:
(i) The event directly or indirectly endorses or selectively benefits or favors (or appears to do so) any private individual, commercial venture, sect, fraternal organization, political group, or if it is associated with solicitation of votes in a political election.
So there are DOD directives and civil laws that says Biden does not have the authority to have the band in performance where, during, or after the political actions are taking place ht can be construed as a performance for the event. And to protect the integrity of the military they should have packed up and left. Anyone of authority who tries to stop them is guilty of a crime. If the original intent of their playing was to enhance the political parts, then whoever asked them to go there is also guilty.

Does anyone remember the military man that Pres.Trump brought up on stage at a rally? The entire news media threw a complete fit and he was reprimanded even tho he was not in uniform. You can’t make this crap up!
Article II of the United States Constitution, empowers the President, as Commander in Chief, to direct the use of military force to protect the Nation from an attack or threat of imminent attack and to protect important national interests. And since the DOD restriction along with civil law in this instance, has nothing to do with these actions, and was violated by both, the president, nor anyone else, does not have the authority to wave the restrictions. If there was an attack at the function, then the president or the vice president could have ordered the band into combat service. But that didn’t happen, so they don’t have the authority to wave a peacetime restriction.
If it had been ordered, it would have been unlawful and could have been ignored except to turn it in to proper authority up the chain after reminding the ordering official that the order was unlawful. And Biden would look really stupid forgiving himself for something so obvious. Even worse than he already has.
