Event though she played this the wrong way, I am on her side. The officer had and has a DUTY to Articulate a Reasonable Suspicion a crime was committed, he had NO EVIDENCE a crime was committed. He should be FIRED and Prosecuted for Assault and Felony Kidnapping
You missed capitalizing a few more words like Her, Side, Crime and Committed. I may have overlooked a few.
The police showed up after the fact. She refused to cooperate.
She was being as uncooperative and as argumentative she could possibly be.
What was the cop supposed to do, walk away?
As far as articulating a Reasonable Suspicion a crime was committed, he told her he needed to see a receipt and she refused saying “I don’t steal”.
I’m sorry but cops cannot and should not take people at their word like that.......she’s just too stupid and too angry to understand that concept.
The officer had and has a DUTY to Articulate a Reasonable Suspicion a crime was committed
“...he had NO EVIDENCE a crime was committed”
The woman was observed by store employees and at that point there is a reasonable need for discovery which the woman didn’t want to accomplish. If she had produced the receipt, it would have been all over with no arrest or need to result to physical actions to complete the arrest.
It also depends on which state you’re in. In Florida, being charged with a crime and being convicted are two very different things.
(3)(a) A law enforcement officer, a merchant, a farmer, or a transit agency’s employee or agent, who has probable cause to believe that a retail theft, farm theft, a transit fare evasion, or trespass, or unlawful use or attempted use of any antishoplifting or inventory control device countermeasure, has been committed by a person and, in the case of retail or farm theft, that the property can be recovered by taking the offender into custody may, for the purpose of attempting to effect such recovery or for prosecution, take the offender into custody and detain the offender in a reasonable manner for a reasonable length of time.

The woman was not arrested for refusing to show the receipt. She was arrested for refusing to follow the commands of the officer in an attempt to accomplish his duty.
Resisting arrest occurs when a person interferes with a law enforcement officer’s attempt to perform a lawful arrest. Some states call the crime “obstruction.” Resisting arrest occurs when a person interferes with a law enforcement officer’s attempt to perform a lawful arrest.

And that’s what got her tased and arrested, she openly defied the cop trying to do what he was supposed to do. If she is going to defy the law to that extent, I have no sympathy for her. She wanted it done...she got it.

“He should be FIRED and Prosecuted for Assault and Felony Kidnapping”
For what? Doing his job? The whole thing could have been cleared up in a minute if this obnoxious lady had simply cooperated with the officer’s reasonable request.
But I do get it. Some people just hate the police and hate authority.
