The EPA is one of the many federal institutions that should be dismantled and done away with. They’re all government regulators, making laws by fiat and none of these institutions have that power. Only congress make laws period.

The law did not mention Carbon Dioxide as a pollutant. The EPA came up with that idea on its own. Unelected faceless unaccountable bureaucrats rewriting laws should be a slam dunk for the Court of Supreme Whim to strike down but I've seen too many other obvious cases to trust it to do the obvious. Like Wickard v Filburn or the failure of that court to take up the case of rewritten election law.

The EPA should not have such power, and the SC should rule against it. But I’m afraid the court will want throw a bone to the left after the R v W ruling. I doubt that Roberts will rule against the EPA.

Carbon dioxide is produced by all human activity. If they can label it a pollutant, and gain from that the ability to regulate it, they have given themselves the ability to control all aspects of human life, down to how many children you have to how much you exercise.
