A federal appeals court has agreed to halt the FDA's ban on Juul products thanks to a lawsuit filed by the e-cigarette manufacturer.
Juul asked a federal court Friday to block a government order to stop selling its electronic cigarettes, and was told the application had succeeded.
The news was first reported by Reuters, with further details on how long the ban on sales will be suspended for yet to emerge.
The e-cigarette maker had earlier asked the court to pause what it calls an 'extraordinary and unlawful action' by the Food and Drug Administration that would require it to immediately halt its business. The company filed an emergency motion with the U.S. Court of Appeals in Washington as it prepares to appeal the FDA´s decision.

There are some details in the news report that shed a bit of light.
Other makers are not affected. Vaping is not per se banned.
FDA claims “emergency” (case filed in appeals court, not district), but sat on Juul paperwork for two years before declaring “emergency”

Today and yesterday were big victories in the Supreme Court.
Are we beginning to see a change also in the lower Federal Courts?
Trump and the much detested McConnell (at least here on FR) were good at not only SCOTUS picks but maybe lower judges as well.

I don't vape either and some of that is so annoying.....BUT, this anti vape was all a cover to promote people smoking cigarettes' which are more deadly than vaping to some degree.....

I was thinking the same re marijuana. I know several people who were finally able to quit smoking by vaping (tapering down nicotine).
Cigarettes are worse for your health than vaping, yet legal. Smoking pot is worse, too. And at least nicotine does not impair driving like pot.

What worried me about the ‘ban’ was the suggestion in the ruling that it would include all nicotine delivery systems.
I know that things like Nicorette have helped a lot of people quit or seriously cut down on smoking.
(My husband noticed yesterday that all the stores had already removed all Juul products.)

I am glad that you are able to use cannabis in a purely medicinal capacity. Of course, the misuse of opioids are a big problem, too.
My issue with the whole marijuana legalization thing is that "medical marijuana" is used to introduce the possibility of using it legally. I have NOT seen a location where
1. Medical marijuana leads to medical marijuana prescription abuse leads to recreational marijuana.
2. The pro-medical Marijuana people make common cause with the marijuana lifestyle folks. Here in Arizona, when we we still "medical marijuana" only, there were ads for marijuana gummis, pizzas, chips, candies and burgers. They don't do that with hypertension medicine or anti-seizure medications. One marijuana "dispensary" chain featured "Dr." Tommy Chong as a spokesman!
I have known good Republicans, especially in Georgia who make a valid case for the use of medical cannabis, often in oil form, not smoking. They ought to disassociate themselves from the Woody Harrelson "pot solves all problems" types. AZ has recreational pot, and is the worse for it.
