“Texas law describes “abuse of a corpse” as any instance in which someone “disinters, disturbs, damages, dissects, in whole or in part, carries away, or treats in an offensive manner a human corpse.”...Texas lawmakers upgraded the crime from a Class A misdemeanor to a state jail felony, which is punishable by six months to two years in a state jail and a fine of up to $10,000.”

Very clear instance of a desecration of a corpse. Since in our day and age nothing is considered sacred, “treating in an offensive manner” is probably the best the law can do.

I don't care...jury nullification. There are more than a few laws on the books whose basic legitimacy I reject.This is one of them.
So *I* vote "not guilty" if I'm on the jury.

Forgot to mention....there are some acts involving the treatment of a corpse which,I believe,*do* deserve serious punishment. More than a few acts,in fact. I won't give examples...all I'll say that watching The Crime Channel as much as I do I see many examples that qualify as "serious" in my mind.
But spitting ain't one of them.

A friend of mine got caught on video coughing on a baby after she got into a spat with the mother. It was 2 years ago
She has been charged and she hasn’t been offered any settlement and her case keeps in being postponed.
It’s in San Jose, Ca. There’s so many worse things happening in Ca that never gets prosecuted, and the DA is prosecuting an elderly woman who just lost her cool.
My friend was in the wrong, but it’s ridiculous that she’s been charged and had to hire a lawyer.

Maybe she thought they were going to burn that body to a crisp and naturally had objections to such an unchristian and barbaric act so she took proactive measures to slow down the desecration of that body by spitting on it.
Someone explain to me how burning a body is OK but spitting on it is a felony?
