The “tip” thing is nonsense - a lie, most likely. That was said by police because they had no actual reasonable expectation they were ‘planning to riot’ other than how they were dressed and riding in the same vehicle. The “tip” gave them the legal basis for further persecution and “found evidence.”
Except I don’t believe it does. Just because somebody makes a call, or “provides a tip”, isn’t evidence of a crime. Your 1st, 4th, and 5th Amendments are still active. They don’t disappear because somebody makes a call, which could just be a lie or a misunderstanding - it’s hearsay.
They should have “reasonable articulable suspicion” of a crime. What crime? Going somewhere to counter-protest isn’t a crime. Being a group isn’t. Who is determining their “white nationalist” status? Even if they are, so what, not a crime. The “conspiracy” claim, to do what? Protest? Do they have evidence they were conspiring to commit violence? Theft? ...more than likely just “offensive behavior” in-front of the LBGTQIA+ crowd.
This looks like nothing more than police arresting a bunch of people that they didn’t want to deal with at a pride parade. Of course the same wouldn’t happen to Antifa.
...lawsuit written all over it imho.
The only real question here is how many of these guys are actual FBI assets. I'd love to see the arrest reports.
