Alec Baldwin's shocking reaction to being told he had killed Halyna Hutchins

Dave Halls, the assistant director who gave Alec Baldwin the gun, admitted that he did not check the gun before rehearsing the scene because he was convinced it contained dummy bullets.

Baldwin's shock after hearing the news of Hutchins' accidental death "I could have killed myself if I thought I was responsible for Halyna Hutchins' death," Baldwin admitted.

"I dream about the accident constantly. I wake up the moment the gun goes off."

A video from the day of the incident has now surfaced in which police investigating the death of the cinematographer are taking a statement from Alec Baldwin.

At the beginning of the interview, the 64-year-old actor was told the harrowing news.

"No," said Baldwin, who immediately put his hand to his mouth.

Alec Baldwin in shock A deafening silence fell over the interrogation room for a few long seconds as Alec Baldwin was in complete shock, covering his mouth and putting his hand over his heart.

"I want to call my wife," he stated.

Baldwin then walked out of the room with his hand to his forehead

They guy with the gun in his hand and firing it is ultimately responsible for checking the ammo in the gun before firing it. Black letter law.

Dummy cartridges and rounds are specially made by hand. A cartridge with a dummy round is marked differently and has a BB inside so that it rattles when shaken.

The gun didn't "go off". You pulled the trigger after pointing it at another human and failed to ensure it was clear of live ammo before pointing it. Once the firearm is in your hands, you are responsible for ensuring safe handling. Nobody else is in physical control at that moment.

He’s trying to c.aim,thay because it was a rehearsal, everyone wasn’t concerned about safety, so it’s not his fault that “people,didn’t take precautions because they thought the gun was cold” the woman asked him “did you check the gun yourself? He said thst “she told me it was cold”- so the answer is nope- he didn’t check. As stated, noone gets to claim that they didn’t know simp,y,because someone else told them it was safe. The one using the gun is to blame, always, the only slight exemption is when there is a defect in the gun that would cause it to go off spntsntiously for,some reason, but still it comes down to the fact that the barrel was pointed at someone when it went off, and the one handling the gun is z,ways responsible for where that barrel is pointed, always. It,doesn’t matter if they think it’s unloaded or not. Many many shootings happen because people thought the gun was unloaded but wasn’t.

This sad episode will be retold in gun safety classes in perpetuity..

It competes well with the video of the arrogant ass teaching a firearms class. He states, "I'm the only one in this room qualified to safely handle this firearm". Two seconds later, the jackass shoots himself in the thigh in front of the class.

Baldwin aimed a gun he did not check at a person.

Just a question here. Not trying to defend him or anything. But was Baldwin actually supposed to open the cylinder, dump all the ammo out in his hand, and individually check each round, before reloading?
As it so happens, years ago I was on the set of a major action movie, and yes, you've heard of it, and never saw this happen. The actor was handed the gun by the prop guy, told it was safe, and the director called "Action".
If the gun was a semi-auto, would the actor be expected to drop the mag, rack the round from the chamber, empty the mag, carefully examine each round before reloading the magazine, inserting it into the gun, and racking the slide to chamber a round?
Just wondering.

I’m not a attorney but it would seem that Mr Baldwin should be facing a charge of gross negligence manslaughter.

I am an attorney.

I think it's unlikely he'll be charged with a crime. Criminal law is about intent. The person either has to intend to cause the result or must be acting so recklessly that the result was likely to occur. I believe it will be determined by prosecutors or a grand jury that Baldwin reasonably relied on the assertion that it was a cold gun and thus his actions did not rise to the level of criminality. Don't get me wrong, I despise the guy and would love to see him spend years in jail, but I don't think it's going to happen.

I do think he will be subject to civil liability to the survivors, though. That's a simple negligence standard, which is a much lower standard than criminal negligence. Hopefully, he will be drained of everything he has.

She wasn’t even in the building when the assistant director handed the gun to Baldwin. A violation of safety protocols in itself. I think the assistant director who handed the gun to Baldwin without checking it is going to be the scapegoat.

According to the New Mexico OSHA report, she was largely cut out of the armour duties, with limited time allowed, mostly working as a prop assistant. And she was never allowed to do any training, even when she complained about that.

Armorer Hannah Gutierrez Reed, the daughter of a sharpshooter and consultant to film productions, was limited to eight paid days as an armorer to oversee weapons and training, and was assigned otherwise to lighter duties as a props assistant. As her time as an armorer ran out, Gutierrez Reed warned a manager and was rebuffed.

They look like a shell without a bullet. There’s also a weight difference with the gun that is noticeable when it doesn’t have the live ammo.

“Based on the apparent facts of this case, it appears incontestable that Alec Baldwin violated at least two, and arguably all three, of those primary gun handling safety rules when he engaged in the conduct that killed Ms. Hutchins.

First, he pointed the muzzle in her direction—presumably directly at her, as she was obviously struck by the bullet fired out of that muzzle.
Second, he failed to first ensure that the weapon did not contain a live round.
The result: the unintended discharge of the bullet into Ms. Hutchins, killing her.
That, in a nutshell, certainly appears to be the “commission of a lawful act which might produce death … without due caution and circumspection.”

And that, as we’ve already seen, is the statutory definition of involuntary manslaughter under § 30-2-3.

The New Mexico statute has been quoted here before. It fits Alec and this case to a tee.

In the context of involuntary manslaughter, § 30-2-3 reads in relevant part:

“Manslaughter is the unlawful killing of a human being without malice. … B. Involuntary manslaughter consists of manslaughter committed in the … commission of a lawful act that might produce death … without due caution and circumspection.”

IF there is any justice left, Alec Baldwin WILL BE CHARGED in this case.

I suspect he WILL BE FOUND GUILTY (because HE IS GUILTY)

Sentencing ? Probably fines, community service, suspended sentence of jail/prison time. Ordered to make movies/public service announcements about gun safety.

I predict that the prosecution will conclude that he reasonably relied on the assertion that the gun was cold and that he therefore did not satisfy the requirements of the involuntary manslaughter statute. I would love to be wrong, but I don’t think I will be.
