A jury took just over an hour Friday to convict Miami-Dade officer Alejandro Giraldo of felony battery and official misconduct in the rough arrest of Dyma Loving, a black woman, who called police for help.
Giraldo was suspended after cellphone video circulated on social media showing him tackling Dyma Loving, who had called police in Miami March 2019 to report that a neighbor had pointed a shotgun at her. Police body cameras also recorded the encounter.
'Police officers can put their hands on people to effectuate a lawful arrest. If the arrest is unlawful, they have no more rights than the rest of us. And he sure as heck can´t tackle her to the ground,' said prosecutor Tim VanderGiesen.
Giraldo insisted he acted lawfully in subduing an unruly woman who was interfering with an investigation.
'What you see there isn't a crime. What you see there is a police officer working the streets, dealing with a situation and maybe his bedside manner was off,' his attorney, Andre Rouviere, told jurors. 'When he arrested Dyma Loving, it was after warning, after warning that she was being disruptive.'
Giraldo, who is Hispanic, faces up to five years in prison at sentencing.
On March 5, 2019, Loving and a friend, Adrianna Green, called Miami police to report that a neighbor had verbally harassed them and threatened to shoot them while pointing a shotgun at Loving.

I was trying to report 3 violent felonies that happened to me — I had them recorded on my phone. The cop was a d!ck, no warning. 2 other charges added. All 3 charges were dismissed, and now I am looking to sue the city of San Jose. But there aren’t very many law firms willing to do this kind of work unless the payoff is big bucks.

That cop was wrong. People have the right to be left alone, unless they are actually doing something wrong. In this case, the cop was contacting you because of something you MIGHT be doing in the future.

Exactly. I would have pulled over had she wanted to reprimand me for having my hands on a pack she anticipated me lighting up. She couldn’t write me up for smoking since I wasn’t, though, maybe something else.
The issue was the child in the car which carries a 100.00 fine if you’re smoking while driving with a minor.

Good suggestions, but it is not actually necessary to do anything further along those lines. I got what I wanted... the police responded quickly. I talked to the responding officer and mentioned the issue with the dispatcher. He said that they were aware of the person's short comings and that it was being addressed.
In my time working in public safety in a supervisory role. I saw much worse in the way of screw ups. One of my former subordinates who was an affirmative action hire, actually hung up on someone who had called in trying to get help for a serious medical situation. It was noticed by another dispatcher, the caller was called back, help was sent, a review of this person's performance was done and the subordinate lost his position.
The person that I was dealing with was an inexperienced young person who probably is not well suited for that type of work. Of course, the problem with public employees is that once they make it past their probationary period, they can be difficult to get rid of even after it is realized that they are not well suited for their jobs.
That was sickening. Both the arresting officer and the female cop were completely out of line.
Thinking that the police are going to take your word for anything is the second stupidest thing you can do AFTER calling the police (1st stupidest).
Being stupid in front of the police is just stupid and they have special prizes for that.

Wow! I am not certain which state you are living in, but in NC it is still legal to open a pack of cigarettes while driving and smoke in a car with a child in it.
Opening a pack of cigarettes while driving is no more distracting than unwrapping a hamburger. Smoking in a car with a child present is not dangerous to the child. Please remember that the studies "proving" the dangers of second hand smoke required the "scientists" to lower the standard of proof so low that if instituted in studies of other substances would require banning many common chemicals.
My Dad smoked like a chimney in all places and at all times. He had four children and all of us went on to become high school varsity athletes in various sports -including track and cross country. Your lungs have remarkable recuperative abilities. There was one interesting study that looked at the "safe" level of smoking. It suggested that most people could safely smoke 5+ cigarettes a day.
Now do I think opening a pack of cigarettes' while driving in traffic or smoking a car with non-smokers is a good idea? No, but but making all "bad actions" illegal is what has gotten this country into a nanny state.
It seems to me the female cop knew what a loose cannon her training officer is and wanted the woman to stop antagonizing him (not the woman’s fault, but the female cop knows what sets him off) without provoking him herself.

Our grandparents painted their houses with lead paint, used asbestos gloves for removing hot items from the stove, etc... and somehow they still lived for a long time, e.g. my Mom is 89 and is still going strong.
Equivocation Fallacy! You are attempting to establish a false equivalency, by comparing an adult, in the 21st century, lighting up a cigarette (a known and recognized hazard) in a motor vehicle with a strapped-in infant, and some old folks in the previous century voluntarily engaging in activities which, at the time, were not known to be associated with cancer risk.
You know that you are making an invalid comparison!
