A jury took just over an hour Friday to convict Miami-Dade officer Alejandro Giraldo of felony battery and official misconduct in the rough arrest of Dyma Loving, a black woman, who called police for help.
Giraldo was suspended after cellphone video circulated on social media showing him tackling Dyma Loving, who had called police in Miami March 2019 to report that a neighbor had pointed a shotgun at her. Police body cameras also recorded the encounter.
'Police officers can put their hands on people to effectuate a lawful arrest. If the arrest is unlawful, they have no more rights than the rest of us. And he sure as heck can´t tackle her to the ground,' said prosecutor Tim VanderGiesen.
Giraldo insisted he acted lawfully in subduing an unruly woman who was interfering with an investigation.
'What you see there isn't a crime. What you see there is a police officer working the streets, dealing with a situation and maybe his bedside manner was off,' his attorney, Andre Rouviere, told jurors. 'When he arrested Dyma Loving, it was after warning, after warning that she was being disruptive.'
Giraldo, who is Hispanic, faces up to five years in prison at sentencing.
On March 5, 2019, Loving and a friend, Adrianna Green, called Miami police to report that a neighbor had verbally harassed them and threatened to shoot them while pointing a shotgun at Loving.

As part of my duties working for a Fire Department, I was sometimes required to work at fire dispatch, so I have some understanding of the frustration involved dealing with the public. But a couple of weeks ago I called in to report a crime in progress and the dispatcher became extremely rude to me and claimed that I was not answering her questions. I was answering all of her questions calmly, thoroughly and completely. She was just not a good listener and was trying to add her own details that were not actually taking place and had no relevance. When I contradicted her preconceived notions, she became angry. It was almost comical, but there are many people who should not be dispatchers or police officers.
That said, certain individuals definitely escalate situations in weird and not so wonderful ways when they call to complain about others.

Back during the Cocaine Cowboy days, the only way to tell the police from the criminals were the police wore uniforms. The gators in the everglades grew fat and lazy.
If you watch that video…cop 100% should have been convicted. He was a total D-bag. Those poor girl had a shotgun pointed in their faces, they were respectful and easy to understand. Cop totally escalated it.
Back when there was a saying on Free Republic. It went thusly: No matter how bad the situation is. Involving the police mates it worse. This is a case in point. Avoid the police like the plague. They are not your friends.
My son had the same sentiment when, many years ago, some neighbor’s would have parties on their deck at 3:00am on work days. He walked over to their backyard and told them to pipe down or else others would be calling the cops. They told him to F’off and he replied, “That’s fine. When the cops get here they’ll shoot your dog and steal your stash”.
The party ended quickly and they never had a late night one again.
In 2014 I had pulled out of a gas station after buying a pack of cigarettes. My daughter was in the back in her booster seat.
I was tapping the pack which was closed, and a police cruiser is on the passenger side in the middle lane, and kept riding closer to the side of my vehicle.
I’m trying to keep my eye on the road wondering what the heck, and she puts her window down, shakes her finger at me in rage,
” YOU LIGHT UP WITH THAT CHILD IN THE CAR, AND I’M PULLING YOU OVER!’
I’m trying to keep my eye on the road, and see her yelling, when I could cars in front of me may need to brake for a turn or red light.
My first instinct was to give her the middle finger, but I knew that would escalate.

I called to report her, and told the police chief or whatever never mind, she could have caused me an accident.
After that, I was pretty paranoid she would find me, again, for telling the dispatcher she was horse-faced, and complaining about her.
Sorry, the police chief acted like what she did was no big deal, and I told him, “Never mind, this is useless.

You were fiddling with a pack of cigarettes (tapping it to make the tobacco slide down to one side?), in preparation of unwrapping it, possibly (as far as the Law Enforcement Officer could surmise) as a prelude to sticking one cigarette into your mouth and lighting up.
Traffic increases and/or something is happening on the road ahead of you requiring your additional attention.
And you are criticizing the LEO for "distracting you?!"
Let me guess: You're now going to claim that you can do three things at once and simultaneously keep 17 plates spinning while your daughter maybe has a melt-down in the backseat and there's a potential traffic pile-up in front of you.

I bet that that LEO could have easily pulled you over and legitimately cited you for three moving violations, as well as finding some other infractions to charge you with.
My take-away: Nice cop let you off easy with a verbal warning!

She could have put on her siren. I would have pulled over, and I wasn’t smoking, and had no plans to. It’s a habit to just tap a pack.
Riding up too close to my vehicle and distracting me could have caused an accident.
