Kevin Berling took his former employee to court after claiming to suffer a panic attack and arguing that his stress caused him to lose his job, WLKY-TV reported. Jurors in Kenton County Circuit Court agreed this week and awarded Berling $450,000, the television station reported.
According to Berling, he asked the office manager of his employer, Covington-based Gravity Diagnostics, not to hold a birthday celebration for him, the Courier-Journal reported. Being the center of attention causes him immense stress, Berling said
On Berling’s birthday, Aug. 7, 2021, his office arranged for a lunchtime party, WLKY reported. Berling said he suffered a panic attack after learning about the surprise luncheon.
According to court documents, Berling left the office and spent the lunch break in his car.

One boss I had did a monthly birthday party for the whole department. Anyone who had a birthday that month was mentioned, but in general it was just a staff party, with no gift-giving. It was fun, nobody objected, and nobody was really put on the spot.
Since they fired him, I’d say he deserved the 450k.

I do not believe any of this crap about ‘panic attacks.’ It sounds like a con devised following some office turmoil which likely developed out of this guy possibly being denied a bonus, promotion, or other consideration. Perhaps there was some other discord which set him on a scheme to get out but grab a bit before the break.
Birthday Party stress sounds rather lame to me.
I just say, ‘I need to speak to a person’. Seems to always work - I get transferred to a live human.

I can understand someone not wanting it, but being that much of a delicate flower, well, I hope he doesn’t handle complicated or important things in his job.
Well you are wrong, people have panic attacks and sometimes end up in the ER, they can be serious. I had Anxiety Attacks and was in the ER at least 4 times because my BP spiked to around 200/100 and I thought I was having a stroke or heart attack.

He will get a job in gov’t office and they will move him around with a raise and have him work from home to get rid of him. He will retire with lots of money after not having to actually work. Note his “immense stress” was overcome by the many many many hours of suing and attending court.

I knew of a guy at Earthlink (ISP) who never showed up while I was there for nearly 4 years (1999 to 2003). He had a doctors notice all the time and the company could not fire him. When they announced that they were closing the site down and gave everyone 2 months notice and said everyone who stayed to the end would get as extra a weeks pay for every year there plus pay for school for up to a year. He had a miracle recovery and showed up. I heard his supervisor talking to him sarcastically about him being there.
I bet he “works” in a gov’t office now....
I have seen a lot. I have worked in the Trauma Room of a very large hospital for years. We rotated our shifts so then typically we worked there a few times a month, but also we went to all Codes and Rapid Responses. More than that.
All sorts of things happen there. Mostly it is people who are on Death’s Door, but we get the Patients with anxiety issues. Usually they are short of breath or suffering from tachycardia. It is scary stuff, particularly for the Patient.
I commented or implied that I am skeptical about this story. I remain so. A person this uptight about a birthday celebration in all likelihood probably would have not made it very long in what seems to be a position that pays well and is not infrequently the focus of attention by Management, Peers, or underlings.
But that all suffer from panic attacks every time we get one of those car warranty extension phone calls...
Maybe they’ll stop!

when they call and they’re giving their spiel press 1 and when the person on line 1 answers say “oh I’m sorry, my bad, I was trying to hang up on you and musta hit 1 by mistake...
I guess being the center of attention at a birthday party was too much stress, but taking the witness stand at the lawsuit was a piece of cake.
Lately I needed something from Fidelity Investments where I’ve had an account for 45 years. Not the same outfit.
Fidelity is useless.
