Here's the very short article text, and it seems fishy to me. I was a California civil litigator for forty years. A bond claim is not a tort claim. I suspect whoever wrote the story is both not a lawyer and way embellished the facts.

"A mother named Violet with a 16-year-old boy who has autism begged the schools to let her son have an exemption.

They refused. When forced to wear the masks he became distraught and he harmed himself so badly that he had to be hospitalized in a mental institution.

Violet obtained the bond for the superintendent of her school district. Turns out – The superintendent was carrying a $4 million liability per bond claim!!

So next Violet served the superintendent with a letter of intent to file a claim against her bond if she didn’t pull back the mask mandates, admit she was wrong, and resign within five days. The superintendent did nothing.

After day 6 Violet filed the claim against her at the bond company.

The very next day we have a recording from the lawyers who represent the district explaining that they have to get rid of the masks, all state and federal funding is BLOCKED, and the superintendent is on her own with regard to the $4 million claim!!!

They also put out a request for parent volunteers to substitute for teachers because their funding is CEASED due to an OPEN claim against them."

I understood it as their was a voice mail with all the statements above, more of a threat, which led the school district to rescind the mask mandate and replace it with a recommendation. Even if that is all that happened, the change from mandate to recommendation is a good outcome, especially for the mother involved.

Some lawyers’ phones need to start ringing in Loudon County, VA and other places.

I am not sure that this is a tried and true tactic, but if it is, Loudon is in big trouble.

After watching the video and the website Bondsforthewin.com, it almost looks like this could be used against many govt folks not following the law or causing harm through neglect or their own willful actions such as the Soros DA’s and mayors.

And the insurance companies shall lead them....

If this is a truly implementable strategy, that is the beauty of it - the insurance bond companies will fight wildly to meet the demands of the claim ...

No way an insurance company is writing a bond just like that and then having the person who obtained the bond make a claim. It would amount to insurance fraud.

The only way to obtain payment from an insurance company like that is with a judgement from a court.

There was no payment made. The district changed their mandate to a highly recommended status. They blinked.

She obtained the superintendent’s bond insurer info and then served her. The video is interesting

Apparently, the insurer followed with threats to the district, which then changed its mandate to a recommended status. Which is really all the mother wanted.

I, also, am not clear on the ramifications, but it is an interesting legal line of attack against leftist bureaucrats.

Where I live, my constitutional sheriff sends his investigators into the bureaucratic morass, arrests them and ultimately sends them to state prison. So far, three are serving time in state prison and two more have fled the state.

I agree. I posted this because it seems like a really powerful strategy, but an experienced lawyer needs to weigh in on it. And if it is, AWESOME!

There are parts missing that are important.

I’ve done similar strategic moves in the past. However, I had the experience as a CPA doing compliance audits on Federal Grants so I knew their weak points.

Would you consider getting involved in vetting this practice and maybe getting involved in helping out. Because if it is a good tactic, I think it is an excellent one.

My takeaway is every elected and appointed position must be bonded. If they lose their bond due to their illegal actions or willful inactions, no other bond company will insure them. If they can’t get get bonded, they cannot work in any governmental capacity.

You know who else falls into that category? County election boards. If this is at all possible, here is a way to get rid of corrupt election officials or at least make them follow the law.

Another group is state college presidents and board of trustees. Lord, let this be possible. What away to get rid of the leftist lieutenants of the culture wars!

The problem that remains is finding a lawyer or law firm or organization that would vet this, and find a way to implement it far and wide. No easy task.

Might be tried and true, might be brand spanking new. But let’s see what can be done with it. We need to define better concepts such as malfeasance, misfeasance, and dereliction of duty. People have been getting a pass on this stuff for way too long.
