Dion Millsap, accused of throwing hot coffee at Dunkin’ customer over mask argument, had to be wrestled to the ground, police say

A man accused of throwing a hot coffee at a customer at a Brookline Dunkin’ after allegedly becoming upset the person wasn’t wearing a mask, has been ordered to stay away from the business and to undergo a mental health evaluation.

Police responded to an altercation at the Dunkin’ at 8 Harvard St. in Brookline after a man allegedly threw hot coffee toward a fellow customer for not wearing a mask in the store, court documents show. The suspect was arraigned in Brookline District Court Thursday afternoon.

The man, identified as 23-year-old Dion Millsap of Dorchester, had allegedly been standing in front of the victim, 56-year-old Matteo Sellitto of Brockton, in line at Dunkin’ when Millsap noticed Sellitto was not wearing a face covering, according to court documents.

Millsap made a comment to Sellitto who then used his shirt to cover his face to deescalate the situation, documents state, but Millsap “became belligerent” toward store employees and fellow patrons.

After Sellitto placed his order and was standing by the counter the report said he asked Millsap what was the matter with him.

Police said Millsap then exited the store. But, according to the store manager who spoke to police, before the door shut, Millsap threw his coffee back into the store at the ground and it hit Sellitto — who was standing at the counter — in the legs.

The two exchanged more words, the report said, and Millsap left after a store manager said she was going to call the police.

But as responding officers attempted to stop Millsap, police said he ran.

“Millsap refused to cooperate and fled the scene,” the report added.

Two officers pursued and then physically restrained him after wrestling him to the ground as he continued to resist arrest by placing his hands under his body and kicking his feet, police said.

One officer sustained an injury to his left hand as a result.

Millsap was arrested and taken to the Brookline Police Station. He was charged with one count of assault and battery with a dangerous weapon, one count of disorderly conduct and one count of resisting arrest.

The suspect’s bail was set at $250, court documents show. He was ordered to have a mental health evaluation and to stay away from Sellitto as well as the store’s Brookline location. Millsap has two prior entries on charges of destruction of property and assault and battery.

Police say they corroborated witness accounts with store surveillance video.

Brookline recently instituted a vaccine mandate on Jan. 15 for all restaurants, fitness centers and entertainment venues, enforceable through a fine of $300 for those who do not comply. It also has a mask mandate that’s been in effect since last fall.
