They’re right. It was a DIFFERENT regulation that they used to mandate vax for federal contractors. However a DIFFERENT court case has that one suspended as well.
I tried to point that out yesterday. The usual Dem “one piece at a time” approach. Has that been questioned?

Like the CMS (Medicare/Medicaid agency) mandate, the separate “federal contractor” mandate is tied to controls on the spending of federal money (Medicare/Medicaid or in the other case just a company with a federal contract). Unlike OSHA, which crosses all industries universally, the CMS and federal contractor rulings are limited to the “employer” scope defined by the receipt of federal funds.
Those who opposed the new deal reach of the regulatory state understood clearly how “federal funding” was a giant foot in the door of “federal regulation”.

No, the stay put in place for EO 14020 from the case in Georgia is still in affect nationwide and the government has suspended the enforcement of it until it’s resolved at SCOTUS.

Lots of luck getting people to work on your federal contract.
And that doesn’t include the subcontractors to the federal contractor, or companies involved with Small Business Innovative Research (SBIR) grants, both which are required to follow the Fed mandate.
Several states have sued already. Not sure of the status but they are on going.
