(The OP is asking if there ‘are any lawyers on here’.)
In post 14 you say, “I’m a lawyer”, then, in 31 you say “I am not a lawyer’.
Which is it?
🙃
She has worked with kids her whole life. Just an error in judgement.
Any idea why she passed judgement on to a kid? A grieving kid, at that?
Had to fess up.
Agree.
“and my wife said maybe he should have.”
Teachers should NOT lay guilt on families.
🙃🙃
Especially kids.
Correct. It’s like asking family of the dearly departed if he/she smoked.
That adds a twist to the story...
If she’s due retirement benefits they may want to strip them.
Let the school suffer without her subbing. Screw them. About the only approach could be a lawsuit for slander or libel but against whom? The student? Did the parents post something?
“That was 20 years ago. No big deal. But today I guess some parent could accuse me of trying to indoctrinate their child.”
Exactly! Society has become so pussified that just having your feelings hurt is a cause for action. We can never win another war with the home front so delicate and fragile.
Want me to check for what the discussions were like? Can’t guarantee as some people don’t have open comments, but many neglect that feature.
This is terrible. I mean, perhaps she touched a nerve. After all it upset possibly the dead person’s child. However, was it the mother complaining to the principal or did the principal just hear about it and decided he didn’t want any of this publicity? How old is the student?
But, while people sometimes make unwise comments, that may even seem cruel, they shouldn’t be ostracized just for that.
This is a horrible time to be alive in this USA.
It doesn’t have to be the student who caused trouble. It could be she just reported the news and her mother (possibly this man’s daughter) flew off the handle.
OTOH, even if the mother was complaining on FB, doesn’t mean she was demanding teacher’s head. Might be just the publicity generated on FB scared the principal.
BTW, you are totally right about people working things out directly. Best to man up and face the issue, rather than sending in someone else to slap at them. Even the Bible says this.
Just like Alec Baldwin
Well I’m not a lawyer, but this does appear to be an egregious violation of teacher ethics, first by inquiring about private medical issues, second by implying that his death was his own fault for not getting vaccinated. I would have been inclined to fire her myself, very inappropriate.
I can't imagine a teacher telling a grieving child in a classroom setting that her recently deceased family member should have been vaccinated. I'm thinking that the conversation somehow got misconstrued or lost in translation.
This is unfortunate, as good substitutes are hard to find and in high demand.
My suggestion is to use the chain of the command and ask to meet with the principal to discuss, and if that is not possible, then ask to meet with the superintendent. I believe that as a matter of professionalism they should provide her an explanation and see if there is a way “through” the problem.
If the above is not possible, I would drop the matter with the school district in question and see if she can get on the substitute list for the area BOCES and neighboring districts.
Regarding Facebook, it’s small comfort but the chattering will die down and then stop. It just takes time. Consider the intelligence of many people posting on Facebook, and leave it at that.
And it sounds like she already knows she made a mistake in asking vaccination status. Earlier this year one of the local schools had some employees asking others if they were vaccinated and then making comments to others that they did not want to work around unvaccinated employees. The school district HR directed that no one should be asking anyone their vaccination status. They also had a employee who is not vaccinated and did not want to work around those who *were* vaccinated, so this employee was asking people their status as well. HR told her to stop as well.
How about your wife, who sounds like a scold, as most teaching lifers transform into after 2 decades of brats, just freaking apologize.
And after that, just don't work there anymore, your wife may fantasize that she has a bunch of 'friends' or even 'colleagues' there, but your wife ain't getting a retirement cake from that place going forward. Period.
Central NY has plenty of private schools, she could moderate silent study halls for nearly the same daily rate, and keep her mouth shut.
