Death on a Movie Set: Ex-Prosecutors, Attorneys React to Alec Baldwin’s Shocking Prop Gun Shooting Accident

A deadly shooting on the set of the Alec Baldwin film “Rust” in Santa Fe County, New Mexico, has resulted in a debate among legal minds about the possibility and likelihood of litigation — even as many of the facts of the matter remain shrouded as of the time of this writing.

It remains officially unclear how a prop gun — generally outfitted with blanks — was discharged by Baldwin on a movie set. The gunshot managed to kill cinematographer Halyna Hutchins, 42, and injure director Joel Souza, 48. The accident happened at the Bonanza Creek Ranch, a stereotypical western film set used frequently by production crews on the southern outskirts of Santa Fe.

However, the New York Post, citing Indie Wire, said that a union which represented prop masters learned that a “live round” was fired. The union said its members were not on set and that local “New Mexico crew members” were, according to the reports.

If it had happened on Murder, She Wrote, Jessica Fletcher would have been on set visiting someone involved in the production, or they would have been filming one of her novels. However, the victim would probably have to be some sort of tyrannical fat producer who smokes cigars.

This might be making more sense. If the union guys walked out and the non union came in, who is to say, or not say, that a union hand might have slipped some live ammo onto the set. Union hands can get quite serious.

If verified, Baldwin may be toast (involuntary manslaughter?).

No he is not. He’s an actor. He depends on a prop manager to give him the right gun. It is not his job to make sure it wasn’t loaded. Now, if it was a gun he brought from home that would be another story. Baldwin really has no liability in this and he shouldn’t. The prop master is another story.

I have to admit that I don’t understand how a live round can get into a prop gun. Then again, it’s technically possible, but it’s not plausible.

The safest gun movies are sci-fi movies that use lasers and phasers. None of those actually have “live ammo”. 😜

Part of me wants to partly blame him, but then, would you blame a race car driver if a part fails, causing him to careen into a crowd, killing someone. Sometimes there needs to be a responsible party for verifying safety. That person should go to prison in this case. But I don’t think it’s Baldwin.

And this was an independent film. They may have been sloppy. “Hey, joe has a glock in his glove box. Get it out and throw a few blanks in it.”

I’m no lover of the scumbag Baldwin. But in all fairness why did set security and the prop master not ensure before use that there were no live rounds on the set? Their liability insurance carriers will be asking the same question before canceling their insurance and both security and prop master will find it very difficult to get insured again.
