As a man lay dying on a Bronx street from a shootout with police, his father snatched the gun from the son’s hands — and used it to continue the gun battle with officers, authorities said.

That’s true. However, this was in response to him already shooting at people so, even if they weren’t the police but just some citizens telling him to drop the gun, best to do that. Most bad guys shoot first and don’t pretend to be the police.
Also, off-duty police carry their badge in their pocket & usually flash it.

The father knew, because right after the son was shot, the police started doing CPR. Then the father ran away and tried to ditch the gun.

In New York City, anyone with a gun is considered shootable by the police.
