Reading the story it could be a legit suit. Guy they employed basically walked up and shot him. He’s charged with second degree murder.
What crime did the dead guy commit?
The only guy charged is their employee.

The security company will be on the hook legally, since their employee is the party charged. Kroger will likely get off on summary judgment, assuming (big if) the judge follows the law.

Almost certainly what really happened is the scumbag decided to go confront the security guard physically and the security guard thought he needed to defend himself.
