PORTLAND, Ore. - An Indiana man, charged with 26 felonies, is now facing federal charges for allegedly throwing an explosive toward police and smashing windows during protests in Portland, Oregon.
Malik Muhammad, 24, of Indianapolis, first made headlines last year when he de-escalated a tense standoff by hugging a police lieutenant in Indianapolis.
On Tuesday, Muhammad appeared in U.S. District Court in Portland, where he was charged with civil disorder and obstructing law enforcement, possession of an unregistered firearm and using explosives to commit a federal felony.
The three federal charges Muhammad now faces are in addition to the 26 felonies in a Multnomah County case stemming from the same allegations, KGW reported.
Muhammad was being held in state custody until May 26, when the Portland Freedom Fund posted 10% of his state-ordered $2.1 million bail.
In a memo signed last week, Multnomah County Senior Deputy District Attorney Nathan Vasquez argued that Muhammad should not be released and no bail be set, given the violent felonies he faces.
But the motion was signed two days after Muhammad had already been released from Multnomah County Jail.
But he wasn't free for long. Last Friday, he was taken into custody on a U.S. Marshals hold. After appearing in federal court Tuesday, he was detained pending further proceedings.
Muhammad was first arrested back in April for his alleged involvement in a number of violent incidents at Portland protests outlined in a Multnomah County indictment, according to KGW.

On September 21, 2020, he attended a Black Lives Matter protest in Portland, Oregon, USA. He is accused of throwing at police officers a beer growler made into a Molotov cocktail, which did not catch fire, that day.
On September 23, 2020, he was caught on camera throwing Molotov cocktail at a police officer during a protest at the Justice Center building in Portland. It exploded and sprayed flames into the leg of a police officer.
On October 11, 2020, Federal Bureau of Investigation agents in plainclothes saw him use a metal baton to break windows of Portland State University, the Oregon Historical Society and several businesses. Police officers found a loaded magazine in his pocket, which matched the loaded pistol he allegedly ditched while being chased.

This federal charge is interesting “possession of an unregistered firearm” because there is no federal registration except for firearms except short barreled rifles, short barreled shotguns and sawed shotguns.

A Molotov is a firearm under the National Firearms Act or NFA.
Therefore, the charge for having an unregistered Molotov, bomb, silencer, machine-gun, etc etc - is possessing an unregistered firearm.
The statute does not change the fact that a US Attorney still has to apply the law, but what I wrote is what the law says under the NFA.
What those two did would have been awful beyond words had it made it into the patrol car. Attempted murder with aggravating circumstances would have been entirely appropriate.
