Dear Boss,
Compelling any employee to take any current Covid-19 vaccine violates federal and state law.
First, federal law prohibits any mandate of the Covid-19 vaccines as unlicensed, emergency-use-authorization-only vaccines. Subsection bbb-3(e)(1)(A)(ii)(III) of section 360 of Title 21 of the United States Code, otherwise known as the Emergency Use Authorization section of the Federal Food, Drug, and Cosmetic Act, demands that everyone give employees the "option to accept or refuse administration" of the Covid-19 vaccine. ( https://www.law.cornell.edu/uscode/text/21/360bbb-3 ) This right to refuse emergency, experimental vaccines, such as the Covid-19 vaccine, implements the internationally agreed legal requirement of Informed Consent established in the Nuremberg Code of 1947. As the Nuremberg Code established, every person must "be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision" for any medical experimental drug, as the Covid-19 vaccine currently is. The Nuremberg Code prohibited even the military from requiring such experimental vaccines. (Doe #1 v. Rumsfeld, 297 F.Supp.2d 119 (D.D.C. 2003).
Secondly, demanding employees divulge their personal medical information invades their protected right to privacy, and discriminates against them based on their perceived medical status, in contravention of the Americans with Disabilities Act. (42 USC §12112(a).)
Third, conditioning continued employment upon participating in a medical experiment and demanding disclosure of private, personal medical information, may also create employer liability under other federal and state laws, including HIPAA, FMLA, and applicable state tort law principles, including torts prohibiting and proscribing invasions of privacy and battery. Indeed, any employer mandating a vaccine is liable to their employee for any adverse event suffered by that employee. ( https://www.osha.gov/coronavirus/faqs#vaccine ). I read somewhere earlier this week that OSHA waived that for COVID. How convenient.
Absent state or federal law, no regulatory action shields employers from civil liability.

OSHA can waive compliance with laws?
Apparently.
I noticed a major dictionary updated the definition for “anti-vaxxer” from “one who opposes vaccination” to “one who opposes vaccination and/or laws mandating vaccination”. Have vaccinations but oppose covid passports? You’re now an anti-vaxxer.
I work at a large chemical refinery. They are not making the vaccine mandatory. However, if you don’t get the shot you must wear a mask at work. That’s it.
We get a $50 Amazon card for getting the shot. I got mine months ago. I don’t give a rip if people don’t get the shot, but as a manager I’ll be dealing with the mask shenanigans unfortunately.
All employees have been informed that as of June 14th they will be returning to work. No more hybrid work from home half the time, etc. This is causing more problems.
I expect they’ll be some turnover at work. Some people I’ll miss, some not so much. Oh well. I spent 24 years in the military before this so I’m used to stern directives.
They’re paying me 6 figures to do a job. I follow their rules and do it. If I want the job and money, I comply. It’s pretty cut and dried if you ask me.
You are just following orders.
Where have we heard that before?
I’m not putting Jews in ovens. I’m working for a private company making a legal valuable product. They have a right to set reasonable working conditions on their property. I can quit anytime. I support a family of 5. Need the salary. Got the shot. Pretty simple. We all have a choice.
Instead, I think OSHA says they’re not going to enforce it ... just as bad.

I guess I don’t get your point. I have no integrity because I got vaccinated? Whatever you say. My company isn’t making the shot mandatory. But masks are if you don’t get the shot. Private property, their rules. So you would quit your 6-figure job over that? Good for you I guess.
