We have had two recent opportunities to take this to SCOTUS: Obama and Harris. SCOTUS does not want it, and the GOP lacks the spherical orbs to fight it.

Prior to the Federal Constitution, all 13 States were instructed to draw up a State Constitution...which they did.
The Federal Constitution covered all 13 states and future states. Remember, it was about 10 years before the Bill of Rights was added.
Go to the Avalon Project to reach each State Constitution. Very informative as many of the Bill of Rights objects were included in those Constitutions.

I cannot recall if the letter that John Jay wrote to Bernardo del Campo, dated Madrid 3 Nov. 1781, came up for discussion way back when Cruz was running. It addresses a birth circumstance quite like Cruz’s, and how a Mr. Vaughan asked Jay to let him take an oath of Allegiance before him, as Vaughan desired to become a American Citizen.
Vaughan was born in England, his father was English, his mother American. (Similar to Cruz)
We see here, in this letter, that in 1781 such a circumstance of birth did NOT produce a Natural Born Citizen.
We all know that John Jay wrote that letter to Geo. Washington, and straightaway the “Natural Born Citizen” requirement was introduced into the draft of the Constitution.
So, here is one letter, written by Jay, which shows that in 1781 a child born outside of the US,to an American mother, who is married to a non-citizen - is most definitely NOT a US citizen.

Completely ignores the definition used by Blackstone derived from English Common Law, which is the backbone of the American legal system. It does so in favor of a Swiss definition applying Civil Law which is foreign to the American legal system.

What about the military? Both my wife and I were born in the US but both of our children were born in Germany when we were stationed there. My daughter was born in the US Army hospital at Landstuhl. But to further complicate matters, my son was born in West Berlin while the city was legally still under Allied occupation. He was born in the US Army hospital in the American sector while I was a member of the US Occupation Forces. At that time, the West German government did not exercise sovereignty over West Berlin. Each Allied power, US, Britain and France, was sovereign over its sector. Both of my children have birth certificates issued by the US State Department that records the birth of a US citizen born abroad. So, are my children Natural Born Citizens or not?
