I don’t see why the city should benefit to the tune of $30K from this guy’s ignorance. In my area if you don’t mow your grass the city issues a citation, and if you ignore it they send a crew to mow your property, then send you the bill.

He would have still racked up a serious bill (assuming they had to send a crew out every few weeks), but not $30K, and at least the neighbors wouldn’t have had to deal with the eyesore.

You sign your life away when you join an HOA, and part of the $30K is going to be attorney and late fees.

This is not an HOA. It’s code enforcement from the city.

I actually have some messy, unkempt neighbors.

They won’t stay in their house, and I can’t always avoid looking at them.

The township tried this on me.

I took them to court and showed that the code requires the township to show who own the property as a prerequisite to a citation. The burden of proof was to be “Beyond a reasonable doubt.

After finding that a survey to determine ownership of the land was over $1,000 and 5 times the fine, I told the judge that if the township paid for the survey and found I owned the land I would pay the fine. If not, I would appeal.

Found Not Guilty...

I got the survey anyway and found that no one owns the land and I am not responsible for the dozen 4 to 5 foot diameter old hollow falling down oak trees on the strip of land. The township now gets to mow and maintain the land perpetually.

I help ALL of my elderly neighbors with their trash cans, pulling weeds in their gardens, sweeping their sidewalks and driveways some just can’t do it anymore GEEZE when people get elderly WHY aren’t the neighbors helping them???

the average salary is $30k in that area.
to pay a $30k fine would require 2 yrs of work (after taxes).

2 years labor seems like a radically excessive fine for uncut grass.

how’s that not a Constitutional violation?

NH is the last state, where if you're over 18, you don't have to wear a seatbelt. Its a Darwinian thing, around these parts.

Your correct about many HOAs.

A home of mine in Texas was in a neighborhood with a HOA with a rigid covenant and aggressive enforcement. One can complain about this combination but we had neat, maintained homes, superb neighborhood pools that hosted swim teams and meets, miles of green belt trails and way above average police and fire protection via a contract with the local Constable and a very well equipped volunteer fire department/EMS. The street lights worked.

One resident in my neighborhood bucked the HOA for whatever reason and refused to pay the yearly $$$ assessment. A lien was filed on the residence and after a few years, the HOA obtained a court order that led to the residence being auctioned off on the courthouse steps to payoff the lien. Damn well read the HOA covenant before purchasing a home and kill the deal if you can’t abide by the terms and $$$.

I’ve researched the law on this topic for our state. There are voluntary HOA’s and mandatory HOA’s.

In a voluntary HOA the rules apply if you pay the dues. A mandatory HOA must have a deed covenant requiring membership.

Our HOA tried raising the dues substantially. So the members dropped out. Then the HOA tried switching from voluntary to mandatory. That idea brought on fury.

I speak only of HOA rules and NOT township zoning.

I won one case for not cutting the grass under the “Right to Farm” law that protects farmers from nuisance ordinances. My client was a farmer and filed annual farm tax returns. He was also a developer.

Where did I lie? I posted that the election was stolen. And the Constitution is no longer relevant. The Democrats rendered it null and void when they stole the election by fraud, thus violating laws they themselves agreed to adhere to. That the Republican Party aided and abetted the fraud by certifying the election as legitimate. Unless you believe the election was above board, and by your posts to me alone, I an convinced that you do. Your friend Liz Cheney d believes that the election was legit. Again, where did I lie? I went back and reviewed the two posts I made. The last post I merely agreed with another poster. Point out the lie, please.
